View Full Version : Just Fired

I was hoping to get some advise or at least a place to rant! Or to see if others had any similar experiences?

I was fired while being sick which is just the mere top of their shady tactics but has anyone experienced this, if so what did you do?

Have you thought about taking them to the labor standards board(or whatever its called)? I would suspect you would have a good case.

And I think they have to give you a month's notice or a month's salary when they fire you.

If you are fired you can also claim unemployment insurance sooner than if you quit. If your employer had not enrolled you in that maybe it's something else you could nail them for.

Anyway, good luck.

Just a wild stab in the dark here but a teensy-weensy bit more information on what transpired might be useful.

So you've just given up your employment AND your hobbies?
:p

. . . I was fired while being sick which is just the mere top of their shady tactics . . .
It sounds like a blessing in disguise. Time to find a good employer.

It may be timely here, though, to note that the Japanese seem to turn up to work (usually wearing a white mask) even when they're near death, and then wait for their superviser to tell them it's OK to go home and die. Some other FG's should be able to confirm or deny that, but maybe that's where a misunderstanding has occurred.

I wish you luck.

Maybe you can apply for FGL's job.

;)

 Actually part of the problem is that I am a terrible corporate cocksucker. I have a very low bullshit tolerance and I refuse to play political games. The new shachou is a total prick and I am not one to take it up the ass.

I am lucky enough to have another source of income that actually far exceeds my "day job" so it is time to get the fuck outa here! :D

Jeez, talk about "out of the pan, into the fire"!!

Hi GirlJapan,
I hope this will help. (http://www.fuckedgaijin.com/forums/showthread.php?t=20983)

I don't know if your route is to legally fight it and/or join the local labor union(労働組合).

The employer has to enroll you only if you work full time. If you are part time, you cant claim if you haven't enrolled yourself. Oh, and the thing about being "enrolled" that many FGs dont get is that you make monthly CONTRIBUTIONS (i.e. PAYMENTS) into the scheme - deducted dirrectly from your pay while you are working.

unfortunately i know too much about this type of thing. i was fired without notice from an eikawa i was working at (fucking american owned, by the way).. but there are very strong labor laws in japan and it is possible to get help a number of different ways. one way is to get a lawyer who will help you take them to court and all that. being a fan of direct action, however, i joined a union who did all the same things a lawyer would have done, but then even after taking them to court they refused to pay me my back wages and the union organized a rally where sixty to seventy people stood outside the small eikawa in nerima with banners and a loudspeaker announcing what the school had done. pretty cool.
.. a note on that.. all of the unions in the tokyo area get together once every two months and do rallies all around tokyo for their various members. pretty cool grass roots organization.
if you want more information on unions, you can PM me.
dont get too down, if you are an english teacher (an assumption, i know..), there is plenty of work, and dont worry about having to hide your negative experience, as many schools know there are some real shitty institutions out there and it can be a way to let any new employer know that they cant take advantage of you so easily.

That is refreshing to know!!!! I contacted the Union, on my second day off is when they canned me, but I think they were looking for reasons to shift me out because I questioned their tactics.

When I took the job, I was hired to teach a such and such per hour and the owner gave me my schedule and I thought perfect, I will be making the average salary, then when I got my pay check... OMG the owner lied about the conditions etc when I called them on it...they were looking for ways to out me.

I can not believe even after the Union got involved they still did not pay you??? OMG.

I sure did, lets just hope they at least pay my June's salary too, which should be in my bank by tomorrow. They should get the letter from the Union this week, I at least if not anything needed 30 days notice not 3 or so hours before I am to start working. I wonder if I should put up a complaint here so others can use that information to take a job there or not.

Exactly and I think quality of life is just as important, and I have a low tolerance as well for shenanigan Employer's, but I think me taking two sick days gave them the excuse they needed or thought they could use.

I was writing about it in my blog, sort of a journal so I can keep notes. Before I took the job (and he asked can you start now, today, next week, please...) when I told him and the add was they were looking to replace a teachers leaving, I told him I had a two day vacation planned in May, and he said okay.. well I reminded them twice after that and to his wife.

And they forgot.. it is a real gong show going on there to say the least but what they did to me was so, so wrong!

I feel sorry for the other teachers too getting their pay deducted, etc.

You took off two sick days because they wouldn't give you time off for a pre-arranged holiday that they had agreed you could have before you were hired and then they forgot about it? Or are these two issues separate?

What was the issue with your pay? They had too many deductions or the hourly rate was different to what they had told you?

Did they fire you within the first 3 months of your starting? This is a probationary period where they can actually let you go without any warning. After 3 months, you are considered a full time employee and you have more options on your side.

hmm... if your former employer is as bad as mine was, you wont see that money unless you take them to court.. of course, they might not be trying to screw you over royally, who knows?
good luck.

I wonder whatever happened to GirlJapan. Any update?

Does anyone know if there is an English translated version of "整理解雇の四要件 (http://ja.wikipedia.org/wiki/%E6%95%B4%E7%90%86%E8%A7%A3%E9%9B%87)"? Although the specific requirements for employee termination apply only for full-time employees, it may not apply for part-time and contract workers like Engrish teachers in this case.

Yeah, that was what I was looking for. Thanks.

I don't know if it will help out GirlJapan with her situation though. She is probably out of the country already for all that I can guess.

It looks like the other site offered her more advice on what to do with her situation. It seems like she got it all sorted out.
Whew!!! I am here to report that I did GET PAID today! I got my dismissal allowance and I think these are the contributing factors:

1. Letter From the Union
2. Faxed them aggressively with my demands (fair demands)

I have to say I am not happy with their work tactics and conditions but I am happy with the end result. The school was ACC English School (http://www.acc-english.co.jp/company/advantage.html), they have schools in Nagoya, etc but to fire someone when they are sick and hire them on false pretenses is a major "loser" in my eyes, so perhaps this will help other teachers who decide to work there make the best decision for themselves but I can only imagine this had gone on long as there are cases brought up against them by other teachers.

If anything, I hope I paved a better path for new teachers to come.

"....If anything, I hope I paved a better path for new teachers to come......"

I paved one of those paths last Monday, for a gal that teachs in a local school. She seemed grateful. Might be a trend.
