Because gaining money or status from a marriage is not, in itself, an illegal act. However, dishonestly circumventing immigration law is an illegal or at least unlawful act. Therefore, a marriage whose only purpose is to allow the successful performance of that unlawful act is itself illegal.
Think in terms of people who have never met each other "marrying" in exchange for a cash payment and then not having any further contact.
