Homeless Man Gets Park Address

The Osaka District Court ruled Friday that a homeless man should be registered as a resident of a public park in Osaka's Kita Ward because that is where he lives.Yuji Yamauchi, 55...attempted[floatr]Image[/floatr]to register his address as the park with the ward office in March 2004. But the office rejected the registration, saying it is not acceptable to set up a private facility -- the tent -- in a public park...Presiding Judge Tomoichiro Nishikawa said in his ruling, "The location of the tent can be considered the residence (of the man) as stated in the law on residential registration, and the city must accept the notification," overturning the ward's rejection of the registration. Nishikawa said the residence should be determined based on whether a location serves as a person's domicile, regardless of whether the person has legal title to the land on which he lives...more...

I don't know, drpepper. I've met a lot of homeless, and they've all been courteous to the point of being embarrassed that they're even being spoken to. Of course I'm not trying to draw a broad general profile -- there are exceptions to and outright freaks on leashes in any social profile, be it homeless, salaryman or eikaiwa no kyoshi. I'm just saying that in my own experiences, the homeless dudes have been occasionally eccentric but on the whole pretty nice guys.

Yeah, except for the smell and garbage all over the place close to where I live, and oh yeah when their wild dogs jumped out and attacked my wife and dog as they were walking by.. oh yeah and the time that one old drunk homeless guy followed me for 2 blocks yelling meaningless gibberish at me getting off his bike and throwing a punch at me.. but other than that, yeah they are great to have around.

If having no fixed address is being "Homeless". Having an 'Official' address recognised by Governing bodies means you now are not homeless.....or does it?
I do not own my current abode, but it is accepted to be my legal address and I am not considered homeless so where is the distinction made?

Not being serious but it is an amusing concept, at least to me.

Have to say I agree with drpepper on this one. Given that most Japanese cities are known for their lack of public parks, having the few that there are filled up with bums and garbage doesn't strike me as clever public policy.

Spot on Doc! I mean I can feel for ligitimate homeless and can see where that can happen. But they have myriad programs and people for those who want help and places they can get help. Bums do not want help. They do not want jobs. They do not want to live in places that will require them to accept some type of responsibility, or worse yet, steady employment. They are completely satisfied where they are and they know intricantly how to work the government, bleeding hearts and all other people who shoulder their "cause" for any freebies they can get. Why is it then when the government provides housing, they have to forcibly move them into it, i.e. the Shinjuku eki denizens. Then they are all gone from the housing within days and moved back in to, in some cases, the very spot they were evicted from. (NOTE: You and I are paying for these so-called "Social developments" with our tax money)! But, don't say that to the defenders of the "cause", you will be immediately labeled as the reason these "poor" people have been downtrodden and brow-beaten for your inhumanity! F**k em!

Kyodo: High court overturns ruling on park as homeless man's address
The Osaka High Court on Tuesday overturned a lower court ruling that a park can be registered as an address of a homeless man. Yuji Yamauchi, 56, has lived in a pegged tent in Ogimachi Park in Osaka City's Kita Ward since around 1998 and received his mail there. The ward office refused to register the park as his address in March 2004, prompting him to file the lawsuit with the Osaka District Court to demand the local government rescind the decision. The district court backed his claim in January last year, saying that a residence should be decided as valid by whether it is serving as the base for a person's living quarters, regardless of whether the person has the right over the piece of land or not. The city office appealed it, arguing a tent is removable and that it would accelerate the unlawful occupation of a park if it is recognized as an address.
