Collections like this usually get torrented these days, and usually only years after the system becomes defunct, and then only amongst a certain crowd. Posting recent system releases on a public website is just asking for it... especially since Nintendo are not lenient towards piracy one little bit...
Copyright law is a bit of an ass however, when it comes to preserving digital history. In order to archive old game titles, they have to be pirated and kept until the copyright expires. If you wait until the copyright expires to copy them and archive them -- you're already in the digital dark age.
