Can he use the "I bought it from a gaijin in Roppongi" defense?

The cause of the accident was a typical Japanese one: overwork. The authorities do not believe he was under the influence.

I heard the same thing. Even though he tested postive for drugs the police blamed it on lack of sleep.

So if he runs to Japan, can he avoid all these charges and live problem free?

I thought of that as well but apparently even marriages between Japanese abroad can be treated like they never happened so that shouldn't stop him.

Utah Highway Patrol investigators said that on the day of the crash, Mikuni was driving on seven hours of sleep, nicotine gum and energy drinks. Investigators have said they didn't believe Mikuni was impaired while driving, but that he was sleep-deprived.

Since when is 7 hours of sleep not enough? Add in some energy drinks and I don't see how he would be sleepy unless they meant 7 hours of sleep in 2,3,etc days

Looking the OP, the traces of illicit drugs in his system might have cooked his goose under Utah state law. If he was partying hard in the days leading up to the crash, those seven hours could have been his first sleep in days. I think you're right that ordinarily that should be enough sleep - hell, I've ridden with friends driving truck over the US and Canada, and we typically slept 3-4 hours a night, popped Wake-ups and Sudafed, blasted loud music, rolled down the windows in winter to get a cold air blast, and rattled small-town windows with the jake brake while running straight pipes.

A year long stay in the Graybar Hotel. I am sure the families of the victims think that is far from harsh enough.

The driver of a van filled with Japanese tourists that rolled on the freeway on Aug. 9, 2010, killing three people, was sentenced to a year in jail and three years probation.

Yasushi Mikuni was also fined $5,000 on each of three felony counts. Mikuni had pleaded guilty in June to negligently operating a motor vehicle while under the influence of a controlled substance.

The 27-year-old was driving a small tour bus loaded with 13 tourists to Bryce Canyon National Park when the vehicle rolled on I-15 north of Cedar City. Along with the three passengers who died, several others were injured, some critically.

Mikuni had traces of marijuana in his system after smoking the night before driving, according to prosecutors.

Two civil lawsuits have been filed against Mikuni, one of which also names Utah companies Canyon Transportation Inc. and Western Leisure Inc., along with a Japanese travel agency.

I wonder if, after he gets deported back to Japan, the J-courts will do anything to him.
