Convicted Rapist Found Innocent

Man jailed for rape released after
accuser's testimony proven false

An Osaka man convicted of rape 3 1/2 years ago and sentenced to a 12-year prison sentence has been released after new evidence revealed the man’s accuser had provided false testimony.

The man – whom Japanese news outlets are not naming – was accused of raping the same woman in both 2004 and 2008, and sexually assaulting her once again later in 2008. The guilty verdict was apparently based largely on the woman’s testimony and that of at least one eyewitness, but the trial seems to have lacked any physical evidence provided by prosecutors.

News reports state the man vehemently denied the woman’s claims and finally managed to get a request for a re-examination of the case via his lawyer this year, but not before serving out over three years of his 12-year prison term.

The District Public Prosecutor apparently found the imprisoned man’s argument compelling enough to personally suggest to the court the case be re-opened; an unprecedented move in Japan, where conviction rates are astronomically high and convictions rarely overturned.

Upon re-investigating the case, the prosecutor found unspecified objective evidence refuting the claims of both the alleged victim and the eyewitness, and the man was finally released by a judge after serving over three years of his prison term.

According to the Public Prosecutor’s Office, this is the second time a conviction has been overturned since 2009.

Lucky for him he was tried in Osaka. Anyways, baby steps are better than nuttin'.

Good luck to him. A shame we'll never hear the details of his compensation award.

Goal is never to get accused of anything but if you ever are, you are fucked:

Detainees can be held under the direct police management for up to 23 days before formal charges are laid. After a warrant is issued, the police can hold a person for 72 hours without laying charges. If they deem that is not sufficient, they can apply for two 10-day extensions. However, if the person faces multiple charges, the charges can be dealt with separately and the process repeated over and over.

Keeping a suspect in direct custody makes things much easier on the police. In comparison with the rules governing a state detention center run by the Ministry of Justice, in police detention lawyers cannot be present in an interrogation, nor can it be videotaped or tape-recorded. There is no legal limit on the length of the interrogation sessions, nor is there a law stipulating that matters raised during interrogation have to be related to the charges. The ‘confessions’ are not actually written or dictated by the detainee but composed by the police and simply signed by the detainee.

During this time, the suspect is not legally guaranteed access to a lawyer, except in cases involving the death penalty...

I would certainly at least do everythng I could think of to destroy her will to live. And I would take my sweet time doing it. And I would make sure she knew why it was done before she finally realised the only way out was to take herself out. Chivalry ends where witchery begins. The eyewitness too, natch.

OTOH, if it were a case of mistaken identity, then it is more an issue with the legal system, but since it was alleged to be a multiple rape with significant lapses in between and an eyewitness that seemed to have lied, I say Off With Their Heads.

A failed shakedown, maybe? I just heard a great story the other night from an LA boy that got taken for $20,000 for banging a local island girl who then called Rape!
