In an escalation of the whaling wars in the Southern Ocean, an activist from the Sea Shepherd Conservation Society boarded a Japanese security vessel Monday, which the activists said was an attempt to effectuate a citizen's arrest on its captain.
Japan's Fisheries Agency confirmed a Sea Shepherd protester intruded onto the Shonan Maru No. 2, which provides security for the Japanese whaling fleet in the Antarctic Sea. It said there were no injuries or damage from the incident at around 9 a.m. Monday Japan time.
The protester, New Zealander Pete Bethune, was the captain of the Ady Gil, Sea Shepherd's stealth vessel, which sank after a collision with the Shonan Maru No. 2 on Jan. 6. Both parties blame each other for that incident, which left one protestor injured.
A statement on the Sea Shepherd website said Bethune seeks to arrest the Japanese captain of the vessel over the "destruction of the Ady Gil and attempted murder of the six Ady Gil crewmembers."
Bethune boarded the Japanese vessel at approximately 6:30 a.m. Perth time, and waited until sunrise to present himself and a bill for $3 million for the sunken Ady Gil.
Sea Shepherd leader Paul Watson said Bethune traveled by jet ski from the U.S.-based group's flagship vessel, the Steve Irwin, at 6 a.m.
Bethune has since presented a letter to the Shonan Maru No. 2 skipper requesting he return with him to the Steve Irwin, to be transferred to New Zealand's Maritime Safety Authority and police.
"If you refuse to be arrested, then I am requesting that you deliver me to Wellington (New Zealand)," Bethune said in his letter to the captain.
"Having sunk my vessel, and with our issuing of a mayday call, you have an obligation under maritime law to provide me with safe passage back to land," he added.
"I will only leave the Shonan Maru when you transfer with me to the Steve Irwin, or when we arrive on land, be it New Zealand or Australia."
In the separate invoice for the destruction of the Ady Gil, Bethune said if payment is not received in four weeks, the group will proceed with criminal charges in Japan against the Japanese government's whaling fleet operator Kyodo Senpaku Kaisha Ltd.
"We will be seeking punitive damages, in addition to the full replacement cost of the Ady Gil...further to this we will be laying criminal charges against the captain of the Shonan Maru (No. 2)," Bethune wrote.
Watson told Kyodo News that the Shonan Maru No. 2 has acknowledged that Bethune is on the vessel.
He added that he believed it would be "unlikely" the vessel would deliver Bethune to a port in Australia or New Zealand.

Kevin Rudd has threatened Japan with international legal action if it doesn't cease whaling, but the opposition has accused the Prime Minister of "dithering".
Mr Rudd said on Friday that Australia was pursuing Japan through diplomatic channels,but had set a deadline for it to end whaling in the Southern Ocean.
"If that fails, then we will initiate court action before the commencement of the whaling season in November 2010," he told the Seven Network.
"But that's the bottom line and we're very clear to the Japanese, that's what we intend to do."

Japan's coastguard is planning further charges against an Auckland anti-whaling protester, the country's media are reporting.
Peter Bethune, a protester with anti-whaling group Sea Shepherd, has been detained since he boarded a Japanese whaling ship in February.
The ABC's Mark Willacy reports from Tokyo that Mr Bethune could be charged with causing injury to the ship's crew.
Mr Bethune is expected to learn his fate by late Thursday, New Zealand time.
He was captain of high-speed protest boat Ady Gil, which sank after a collision with a Japanese whaling ship in January.
The skipper boarded the Shonan Maru No 2 in protest at the incident, was detained and taken to Japan.
Seattle lawyer Dan Harris, who has been working on Mr Bethune's defence team, says it is likely he will be charged with trespass.
However, Mr Harris says to charge Mr Bethune at all could be viewed as political and he should be released.
"Japan does not need to embarrass itself by prosecuting somebody for a little action like that and if it does prosecute him, it's really going to look like they're doing so at the behest of a tiny but very powerful group that controls Japan's whaling industry."
Mr Harris says it is frustrating that Japan has overlooked what he believes was the intentional sinking of Ady Gil.
"Under international law, the Japanese maritime authorities are supposed to investigate major accidents at sea involving Japanese vessels, and near as we can tell they have completely ignored that law and done nothing in terms of investigating."
Mr Harris says Mr Bethune is in a Tokyo jail, does not have any family with him and was not able to apply for bail.
If found guilty of trespass, Mr Bethune could face up to three years in prison or a fine of up to Y100,000 ($1,166). Inflicting bodily injury carries a maximum jail term of 15 years, or a fine of up to Y500,000 ($5,833).
The other charges carry lesser penalties.
Greens leader Senator Bob Brown says it is unjust that the captain of the anti-whaling vessel Sea Shepherd is facing up to 15 years in a Japanese jail.
"It is Japanese whalers who should be facing charges under Australian law for endangering lives, not Sea Shepherd captain Pete Bethune," said Senator Brown.
"It is absolutely unjust that Captain Pete Bethune is facing up to 15 years in prison in Japan."
He said the Australian Federal Police are investigating an official complaint by Sea Shepherd over the ramming and sinking of protest vessel Ady Gil by Japanese whaling vessel Shonan Maru 2.
"Under Australian law the captain of the Shonan Maru 2 should be tried and face life imprisonment for his actions, which endangered the lives of six people," Senator Brown said.
