Never expect the courts to enforce what should be a personal matter. As long as the mother is competent enough to support the child, this should be an open-and-shut case of divorce with no visitation (standard procedure for Japan), but with court-enforced child support.

So has this judge set a legal precedent that if the accused has children his going to prison would place a burden on the child?:?

Bet the judges next case was a Gaijin who stole a bicycle and the judge gave him 5 years in the slammer... :twisted:

That judge needs to be removed from office.. he blatantly disregarded the child's safety. That is careless and reprehensible.

How can he even justify helping the child by letting the father go??? That to me seems retarded.. perhaps he's suffering from dementia???

One explanation for the bizarre rulings handed down by Japanese judges could be the way judges are selected in Japan. Unlike the US (and I presume other Western countries), law students in Japan can become judges without any prior experience practicing law. They just choose the "judge track" after getting their law degree. This means that cases in Japan may be adjudicated by people who are inexperienced in life and the law:

Lower court judges are appointed by the Cabinet from a list prepared by the Supreme Court. The list is generally composed of persons who have passed the Bar and who have completed two years at the Legal Research and Training Institute. The recruits selected from the list serve as assistant judges for ten years, after which they can be appointed to full judicial positions, renewable every ten years.

I believe a reform has been proposed (and maybe passed, although I'm not sure) that will vest judicial powers in "citizen judges" in Japan. That means, instead of a jury, you would get a layperson to decide cases. Although that would scare the shit out of me, the results couldn't be any worse than what happened in this case.
