Domestic abuse case against Japanese consulate official resumes in San Francisco
A domestic violence case involving an official at Japan's consulate in San Francisco is back on track after problems with an interpreter caused a delay in the case, officials said Monday.

Yoshiaki Nagaya, 33, who serves as vice consul in the Consulate-General of Japan, is facing domestic violence and assault charges for the alleged abuse of Yuka Nagaya, his wife of about two years.

Yuka Nagaya claims she had been the subject of abuse in more than a dozen incidents, including being stabbed with a screwdriver, being stomped on and being thrown out of a moving car.

Her testimony during Monday's preliminary hearing was delayed when an interpreter hired by the defense said the interpreter translating for Yuka Nagaya was making mistakes, said San Mateo County District Attorney Steve Wagstaffe.

When defense attorney Garrick Lew raised concerns about the accuracy of the translation, the judge agreed to delay the case until a new interpreter could be found, Wagstaffe said. Testimony resumed late Monday afternoon.

More testimony was scheduled for Tuesday, with Yuka Nagaya expected back on the witness stand.

Yoshiaki Nagaya, who is free on $350,000 bail, was arrested by San Bruno police March 31 after he allegedly pushed his wife from a moving car. He has pleaded not guilty in the case.

In an email responding to a request for comment on the case, defense attorney Lew wrote, "Let's see what happens after the defense presents." He did not provide additional details.

I had one of these screwdriver confiscamated either in Taiwan or Hongkong airport safety check... Seems you can hijack a plane with those terribul weapons of mass destruction... Still feeling better than the guy in front who had his Audi keys confiscated because of the switchblade like opening mechanism... Even if you can consider that when facing such a prime example of moron-in-uniform killing it might do the world a favour... sometimes... just the idea that a replacement key could pay for several days wages for this imbecile is good enough...

Looks like the guy is getting off easy

A Japanese diplomat living in San Bruno pleaded no contest in San Mateo County Superior Court Thursday to two counts of domestic violence.

Yoshiaki Nagaya, 33, wore a black suit and a light blue tie when he entered his plea through a Japanese interpreter.

Nagaya, a vice consul for Japan stationed in San Francisco, had been accused of committing “constant acts of violence” against his ex-wife during their 18-month marriage, District Attorney Steve Wagstaffe said.

According to prosecutors, Nagaya allegedly stabbed his wife in the hand with a screwdriver, knocked her tooth out during a separate assault, and kicked her multiple times.

Nagaya’s wife, who is much smaller in stature than her former husband, photographed her injuries after each attack, Wagstaffe said.

In March, the victim approached police and claimed that Nagaya had pushed her out of a car in the parking garage of their San Bruno apartment complex, Wagstaffe said.

Investigators were unable to substantiate the accusation, and questions about the wife’s credibility prompted the district attorney’s office to drop all but two of the charges against Nagaya, which ranged from assault with a deadly weapon to spousal assault, Wagstaffe said.

Nagaya’s plea of no contest to the two remaining felony domestic violence charges could bring a sentence of up to a year in jail, according to the district attorney’s office.

She testified that the abuse began after she found a woman's photo on his cell phone and became suspicious that he was having an affair. She said she never had solid proof that he was cheating but that it nonetheless prompted arguments during which he attacked her - once with a miniature screwdriver and another time with a laptop.


questions about the wife’s credibility


Sounds very likely she was a crazy herself. Not that it justified what he did...but sounds likely she was caught embellishing what went down and that lead to such a light sentencing.

IIRC, earlier it was reported there were some interpretation problems with testimony. I imagine the hubby is fluent in English, and the sole provider for the couple. She's there in the US, perhaps a faltering command of English, no funds of her own to pursue any legal recourse - so must rely on a public defender and volunteer interpreter. Not exactly a level playing field.

NB: She still might be nucking futs.

I missed the interpretation problem reports...that could easily be used to make her testimony look unreliable.

Basically, d00d got sentenced to a year in a plea deal and then the J-gov gave him only a 6-month suspension to show how embarrassed they were by his actions :roll: On the other hand, his defense lawyer claimed the knocked out tooth was proven to have come out from decay :lol: and had a whole bunch of other stories, claiming she was batshit crazy. (but doesn't really explain a screwdriver through her hand??)

Anyhow, the reason I dredged this topic up from the grave is a talk I had with a fellow FG that married about a year ago. He had a big fight with his J-wife that basically boiled down to her being really passive aggressive with him for a number of things. When he asked her why she didn't just bring them up when they happened, and hash it all out...her response was "but but, you're gaijin and I know gaijin do DV when they're angry!" :wall: Went down the "you know I've never hit you, why would you think that?" list of logic and got nothing but "because gaijin." Tis gonna be a fun ride for him it seems :twisted:
