BTW, allowing that race is BS, Indian Indians are Aryans but not Caucasians because they're south and east thereof, hence the term. I do agree that most non-southern (Tamil, etc.) Indians are structurally pretty much identical to white people. The northern Bollywood chicks look pretty much European with skin paint. At a hearing on Monday, prosecutors announced a change in their case against Gregory Gumo, a 41-year-old marketer in the entertainment industry, in the death of 42-year-old Mariko Akitaya, whose body was found floating in Koajiro Bay.
Prosecutors had previously asserted that Gumo had murdered Akitaya, a resident of Tokyo’s Meguro Ward, and dumped her body. However, prosecutors on Monday changed their case, claiming that she was still alive at the time of the abandonment.
“In a misguided belief that Akitaya was dead, Gumo, the defendant, dumped her body in the ocean while she was unconscious,” the side of the prosecution said.
Prosecutors also announced that a murder conviction will not be sought.

There is a difference in the intention behind the act of killing someone by restraining them and dumping them in the sea, and the act of dumping a body you believe to be already dead. They evidently don't think they will be able to establish that he planned to kill her by drowning her because the evidence they have is that he already believed her to be dead. You can't drown a corpse. No proof of intention to kill in that manner (or, evidently, any other).

"He tried to poison her but was unsuccessful....but eventually she was inadvertently killed when he mistook her for dead and unsuccessfully tried to hide the evidence and dumped her in the ocean. Therefore we can conclude it is a case of accidental death and littering."
