Prosecutors decide not to indict SMAP singer Kusanagi over indecency

Tokyo prosecutors said Friday they have decided not to indict pop star Tsuyoshi Kusanagi over public indecency because he showed regret and has already incurred social sanctions. The 34-year-old member of popular music group SMAP was arrested naked and drunk in a central Tokyo park at around 3 a.m. on April 23 and was sent to the prosecutors and released the following day.

The incident has cost Kusanagi, who is also popular in South Korea and other Asian countries, lucrative endorsement contracts and TV appearances. He has also refrained from entertainment activities.

Referring to the reasons he escaped indictment, an investigative source said Kusanagi, who was arrested in the park next to the landmark Tokyo Midtown complex in the Roppongi-Akasaka area, regrets his act and has no criminal record.

Appearing in a packed press conference April 24 hours after his release from detention, Kusanagi apologized to his fans in Japan and other parts of Asia and said he does not know when he can resume his activities as a celebrity.

TOKYO (Reuters) - What's wrong with being naked?

That's what a Japanese TV star asked police who arrested him for public indecency when he was found drunk, naked and screaming in a Tokyo park in the early hours of the morning last week.

His words struck a chord with the public and have now become the slogan on a new range of T-shirts sold by online retailer ClubT. (clubt.jp/product/53243.html)

"They are definitely selling," said company spokeswoman Nanako Shibuya, who said she could not give precise figures.

Tsuyoshi Kusanagi, 34, who shot to fame 20 years ago as a member of boy band SMAP, resisted arrest and was bundled into a police vehicle wrapped in a blanket, media reports said. Police questioned him at length and also searched his home.

Prosecutors decided on Friday not to charge Kusanagi, media reports said.

But the incident has sparked sympathy for Kusanagi. Many Japanese complained the slight, serious-looking actor was treated too harshly, especially after he appeared close to tears during a news conference he called to apologize for his behavior.

One fan threatened online to attack the Akasaka police station where he was held, the Asahi newspaper said last week

Kusanagi Tsuyoshi (34) is ready to get his career back on track barely a month after his arrest, according to a statement yesterday from Johnny's Jimusho (profile). He will join the other members of SMAP on May 28 to record their weekly variety show "SMAPxSMAP," which will be aired on June 1. On May 29 he will make his first live appearance, in his regular slot on the afternoon show "Waratte Iitomo," and record the narration for the music show "Bokura no Ongaku." Filming of the new "Jinkyo Helper" drama series in which he stars will begin as scheduled in June and the show will aired as planned from July. All the shows are on the same Fuji TV network. Johnny's said that they are cooperating with Fuji and that Kusanagi is likely to give a press conference before his return to work. Although he was let off with a suspended indictment after his April 23 arrest for public indecency, the speed of his return is about money more than an admission of the limited impact of a rare drunken outburst on public morals. If he had received the standard punishment of several months probation, the losses from his TV, radio, movie and commercial contracts would have been in the billions of yen. There was also the outpouring of support from fans, many of whom thought that police had been unnecessarily harsh on someone who, at least when sober, is rather shy and one of the country's most unassuming celebrities.

The Asahi says (Japanese) that Kusanagi has just been picked again to promote the switchover to terrestrial digital broadcasting which just about completes his official rehabilitation.

Yup. But I think they were pretty strict with him. He was warned about getting drunk and running outside nude and told this is definitely not acceptable behavior in Japan if one does it more than once or twice a week.
