Asahara not fit for trial: psychiatrist
The Japan Times: Jan. 17, 2006

Lawyers for Shoko Asahara, founder of the Aum Shinrikyo religious cult, released portions of a psychiatrist's report Monday stating that Asahara is unable to stand trial because of his confused state of mind.

The report of Masaaki Noda, a professor at Kwansei Gakuin University, will be submitted to the Tokyo High Court, the lawyers said. Asahara, 50, who has been sentenced to death and whose real name is Chizuo Matsumoto, is in the midst of an appeal. Based on the report, the lawyers will ask the high court to suspend the appellate trial. Asahara has been found guilty on 13 counts, including the 1995 sarin gas attack on the Tokyo subway system.

"If competency to stand trial is defined as understanding the meaning of the trial and the ability to defend oneself, then (Asahara) should be deemed lacking in such competency," Noda said in the report.

He also stated in the report that Asahara's symptoms may improve in about six months if he is given immediate psychological treatment and that reopening the trial after his recovery would be more practical than arguing over whether he is pretending to be ill or is actually confused.

Three of the four psychiatrists, including Noda, who have interviewed Asahara have expressed doubts about his competency to stand trial. Another is drafting a report stating that Asahara is suffering from a mental disorder caused by his long stay in prison.

What ever happened to "crazy"? People nowadays always have some sort of illness that makes it suddenly "not their fault" that they killed someone. I can see and understand this in a tiny minority of crime cases, where someone has a legitimate medical condition. However, recently *everyone* is just "not responsible" for their own actions. This is ridiculous. That fucker is nuts. He belongs in a prison, not in a rehabilitation center. He knows what he did, and he should go to jail for it.

Of COURSE he's a total whack job. He tried to kill hundreds, even thousands of people. Society is based on cooperation- previously, those who did not cooperate got outcast. Those who DISRUPT that cooperation by murdering or stealing were punished or removed from society to show that it was not acceptable. In modern years, this has been changed to try to allow all people of all sorts to do whatever they would like, assuming they are not disruptive, and in most cases it is for the better. However, to allow someone like this to get ANY sort of reprieve for a premeditated, horrible crime, is simply irresponsible.
Why do the Japanese always have to have a favorite saying?

Watched a documentary call "A" by Tatsuya Mori in which the doc-maker has full access to the compounds and members before during and after Shoko Asaharas trial.
The focus is on 'Araki' the PR 'man' (hes more like a kid) and a kind of likeable character & the people that you see for the most part seem to be quite normal, although they do have strange diets, rituals and beliefs.
In one segment you see how dirty the cops can be in Japan: some detectives were harassing members for their names in the street , and one plain clothes cop was obstructing and then hanging out of this guy, so eventually when he tries to walk/halfrun off - the cop tackles him to the ground in such a way that he tries to make it look like he came off worse and they arrest him for assault on a policeman. meanwhile the guy that was just trying to get away, lies on the ground with a concussion until an ambulance in eventually called. The cops put him in confinement until the doc-maker and a lawyer make an agreement to hand over a tape from there footage that shows the cops intentionally taking him down and because of the tape the cops let him go.
Its an interesting piece and whats addressed isnt exclusively focused to the cult.

Hey, it's the era of PC, you cannot say anything that resembles an adjective, or you will have infringed on a living creature's rights, be it an amoeba, or a sperm whale, with the two legged mammals falling in there somewhere.

Japan does do it right though, whether you are nuts or not. The defense appealed Miyazaki Tsutomu's conviction for folding, spindling and mutilating (not to mention murdering and alleged selective consumption) of four young grade school girls all over (literally) West Tokyo and Saitama. Their appeal was based on the difference between his first psych exam, which said he had bats in his belfrey, but was otherwise culpable and his subsequent exam, which said he clanked when he walked and was generally as responsible as a fruitcake.

The court said it was a nice appeal, but announced yesterday they were going to hang that mother just the same! I thought this was an excellent decision, since I didn't want him dropping by his old neighborhoods, one of which is where I was residing. I also might add that this was another timely decision by the J-courts, as he was just arrested the other day (in 1988 )!
