Toyobo Co. said...it has come to an agreement with a U.S. police officer to settle a litigation in the United States in which the American sought damages, alleging that he suffered injuries because a bulletproof vest made with the Japanese firm's material failed to protect him. The Osaka producer of the Xylon fiber, which was used in the vest, claimed that the court battle will only have a modest effect on its earnings performance, while declining to disclose the terms of the settlement. The settlement was reached between the plaintiff and all defendants, including the vest maker Second Chance Armor Inc., Toyobo said. Toyobo, however, still faces outstanding lawsuits filed by the U.S. government and the Michigan-based vest producer in connection with Xylon.

Mainichi: 2 German states Sue Toyobo over bulletproof vests

Toyobo Co. said Friday that two German states have filed a lawsuit against the company over alleged defects in bulletproof vests made from Toyobo's Zylon fabric. In the lawsuit, filed in the U.S. state of Michigan, the German states, Bavaria and North-Rhine Westphalia, are seeking damages worth 8.2 billion yen from the Japanese textile company and former executives of Second Chance Body Armor Inc., the defunct U.S. maker of the vests. Toyobo said it is ready for the legal battle, claiming that the materials maker should not shoulder the blame for the vests' alleged defects. Although there have been no accidents caused by the alleged defects, the two German states are seeking replacement costs for Second Chance products they bought through the German unit of the U.S. maker. Osaka-based Toyobo has been involved in a total of six suits in the United States in connection with Second Chance's vests. Plaintiffs include the Justice Department.

In a fatal case of "Lost in Translation", Japanese company Toyoboyo is being sued by the US Justice Department for knowingly selling defective body armour. Specifically, Toyoboyo's managing director, chief translator and karaoke king for the last 3 years, Mr Nobagakirai, is accused of gross-negligence in interpreting the request for bullet-proof vests as a request for burrito-proof vests.

The error came to light when a Texan police officer, caught in a Mexican stand-off, died in a hail of burritos, I mean bullets, in February this year. When the US requisitioning officer checked the specifications received with the vests, instead of the expected details of a high-tensile strength polymer being used he found washing instructions.

"We immediately requested Toyoboyo to set-up a testing of the vests and that's when it really hit home", said a US spokesman. "We turned up to the firing range expecting to see various calibre weapons ready to be used but instead found the Toyoboyo people preparing hundreds of burritos!"

Toyoboyo has refused to comment.

Japan Times: U.S. sues Toyobo over Zylon fiber

Toyobo Co. said Monday it is being sued by the United States over allegedly defective Zylon fiber it supplied to U.S. manufacturers for use in bulletproof vests. The suit, filed June 26 in Washington, claims Toyobo sold the fiber to Armor Holdings Inc. and four other U.S. makers of bulletproof vests with the knowledge that the material was defective and would deteriorate faster than the company said it would. The amount of damages being sought is not mentioned in the lawsuit, which is one of 19 Zylon-related suits filed against Toyobo. Thirteen have been settled out of court.
