Don't drive, but I do cycle, in an "expect the unexpected" way (from pedestrians, other cyclists [*] and anyone else), and when cycling on real roads (which basically means I'm riding along the strip between the concrete gutter and the tarmac) I'm very aware that the vast majority of powered vehicle drivers are ultra-paranoid about overtaking even when there's room to pass. Presumably because the "bigger is more at fault" assumption is very strong here.

This is compared to Germany, where one basically had to assume that despite a nominally bicycle-friendly infrastructure, the hydrocarbon-powered vehicles were basically out to get you.

[*] speaking as a cyclist, the majority of cyclists are batshit insane and deserve what is coming to them.

When I got knocked off me mama chari, my J hubby got all scary on his ass and the driver bought me a new bike, paid my hospital bills and gave me a wad of cash.

But that was the '90s

I need another operation so still not at the lawyer stage yet. As far as the 10-0 blame game, everyone I have spoken to has said the same thing, if your vehicle is moving then you are partially at fault. Japanese logic at it's best.
However the insurance company has paid 100% of my expenses so far, or at least 100% of my share after health insurance so I am not personally out of pocket. My search for a lawyer continues, I did get some contact numbers from my embassy website, after the next op I hope to be in a position to start negotiations.

I drive as carefully as possible....but I swear the scooter crowd is full of kamikaze. Meeting up with IPU the other night, I'm in the far left lane, put on my turn signal to pull into a gas station, start to pull in and I hear screaming. I didn't even see this scooter tard come flying up on me from behind and try to pass me on the left. (almost went splat into the passenger side of my car but hail mary'd his way around me) New dashcam caught the whole thing and IPU was outside, watching the whole thing so would have got real interesting if he actually hit me.

Wow, that sucks...shit like this stays with you. Be sure to keep updating us and hold to your guns!!

As to Japanese logic, yep...surveyed nearly all the j-people I knew and while every one of them says "it's soo stupid to do it this way" they agreed that the way the insurance companies here (not to police) deal out the blame is at least partial fault if you're moving....even if it's impossible to stop in time and you had the right of way. :wall: In typical North Korean style, the police also refuse you access to the CCTV video of the incident. I'm trying to get my friend to play hardball with the insurance company and demand a copy of the video so we'll see what happens. I really don't understand your own insurance company wanting you to accept any % of blame when the other person is the one clearly in the wrong....unless they try to use this small % to raise your rates?

That's not the issue I have, I'm only looking to get as much compensation as possible, so getting a lawyer would be the best course of action. The driver who hit me admitted responsibility, my expenses so far have been paid, treatment is ongoing. If I end up with 10% blame apportioned I don't care, it's just the Japanese logic numbers game. As long as I get treated and paid enough I'm satisfied.

On the subject of Japanese logic, I asked a few questions here recently, wasn't sure whether to laugh or cry at the responses.
Q1: "What does the yellow light on traffic lights mean?" ----- Answer... "Accelerate to beat the red light"
Q2: On the subject of the self driving cars recently in the news... "If there is an accident between a 'self driving car' and a pedestrian/cyclist/wall/other car, who is responsible?"
Answer #1 from an old man who clearly believes the bullshit.... "Self driving cars can not have accidents because they are controlled by computer"
Answer #2 from other people in the group "Insurance company is responsible"

As they say, common sense isn't actually common

He did what? A real man would have left you on laying on your ass, immediately checking on the other guy to see that he was alright, taking him out for a pint, apologizing for the dumb bird on the mama chari. He would have then bought another pint for the geezer and explained how he would take care of the bird when he got home, so that she wouldn't cause any more trouble as a mama chari bozozoku. Must be something effeminate in those Tohoku doods…

In my friend's case, it was a family mart CCTV camera that caught it on video and the manger was "advised" by the police not to release/show the video to anyone except the insurance companies. I went there with my friend and a copy of the accident report and the manager tried to give me this whole spiel about privacy and not wanting to show "regular people" everything they are recording. I argued a bit until the manager basically agreed to show the video to us if I could get an insurance rep or whatever to come with us. Not sure if that's going to happen but pushing her insurance to just obtain a copy of the video seems easier.

As I updated the original post with her injuries, I should also mention the major hospital that she was 99sya'd to after the accident took several exrays and charged up the ass for it, only to tell her she was completely fine. Still in pain and wanting to see a doctor she knew better, she got copies of the x-rays and took them to her trusted doc. Sure enough, based on the same fucking x-rays, he found she had a fractured wrist and some dislocation near her collarbone. (not sure on the specifics of it) and put her into some sort of cast-like thing for her wrist. First hospital: Japanese medical care at it's finest...god damn this cuntry is scarey sometimes. Not sure what the first doc/hospital has to say about such a major fuckup...friend's mother says at the very least they are refunding everything they paid for...but I'm really tempted to make an appointment with the doctor and go there with a video camera. Would make for some great PR on YouTube, yes?

Not sure of the procedure, but there is certainly a local doctors committe-thing to which you can complain in order to bring an investigation. Depends on how much everyone sleep with everyone though...

So i had to get a tube down my throat so they gave me some drugs to pass out... As i went to sleep I told the nurse that i was feeling all fucked up and grabbed her tit in my final seconds trying to hold myself up.

Not sure if it was a death grip or not... But that was the last thing I remember...

Not as good as Choko's story(ies), but i gots mine!

Recently I also had to get my stomach examined by camera, but since the nurse was an Obachan without any tits to mention of, I chose the wise option for a camera going in via my nose. Only needed a light local narcosis, though I got a good exercise at mouth breathing.
