Changes in I-130 process - anyone know about this?

Hey all,

I was wondering if anyone here is familiar with the changes in the I-130 process. I was checking out the U.S. Embassy - Japan site and came across this new info:

"IMPORTANT NOTICE

Effective immediately, overseas consular posts will
no longer accept or adjudicate I-130 petitions."


From what I gathered, this has to do something with the Adam Walsh Child Protection act or something like that - it basically means that the U.S. needs to make sure that all I-130 applicants didn't steal / touch any kids in bad places and that only the USCIS offices in the U.S. are deemed to be capable of doing this background check.

Now on to my dillema:

My J-gal and I currently reside in the U.S. and are ready to get married, but we were planning on taking care of the marriage / I-130 paperwork in Japan so that we don't have to suffer a fate similar to what AK and his wife are going (went?) through.

However, from what we hear, it sounds like we can't do the immigration / green card process from Japan at all. Wherever we decide to marry, we'd still have to send the paperwork to the office in the U.S.

We're currently doing our best to examine every option available to us, but I figured that it wouldn't be a bad idea to see if anyone here has any info/advice reflecting this new law. So then... does anyone here have any advice / information regarding this change in immigration law?

That development was raised towards the end of this thread. Albert might be a bit further along in the process if we can catch his attention to give us an update.

Just wanted to know, why would you want to move to America, when Japan is such a nice country. :cool:

Anyway, I wish you the best with the visa and hope you can get it quicker than expected.

Japan is nice and all, but we both already live in the U.S. and actually like it here (despite its faults...)

I also have a great job here that I'm not too eager to leave. Moving to Japan would essentially require me to leave my well-paying (for me) dream job to to work in an eikaiwa... That said, I would consider moving if the right career opportunity presented itself. There are more career opportunities in the U.S. for my fiancee as well.

Thanks for the words of encouragement. I'll be sure to post any relevant info as I get it.
