I'm assuming that it is 2mil yen and not 2mil $.

If you have filed income tax returns with the IRS for your time here then I expect no problems sending the money home. It's your share of money that you earned over the past 3 years here and you've already paid whatever tax may have been owing on it.

If you haven't been filing yearly then I would look into taking care of that PDQ.

Yeah, isn't it lovely how US expats are pretty much the only expats in the world who have to file US tax returns and pay US taxes on foreign-based income over a certain threshold. Someone's gotta pay for the Military-Industrial-Halliburton-Blackwater Complex, I guess.

Getting back to the OP, why not a 50/50 asset split?

Either she made most of the money or you have a guilty conscience...either way a 50/50 split does seem in order.

I think FG Lurker is right. If you have been filing in the states I don't see any problems in wiring the money... but if you want to be on the safe side you could...

Wire around $9,000 and take the rest in cash. (I believe backs only report amounts over $10,000 to IRS) Then you could carry in the rest in cash with out the IRS never knowing about it."

I'm not sure if the government follows the $10k rule for carrying cash these days or not. There are many stories of people having cash seized by government agents and then having to prove that they earned the money legitimately. Can't prove it to the govt's satisfaction? You don't get the money back. Yep, the USA... "land of the free"

Utada Hikaru's mom knows a thing or three about cash-sniffing dogs (I can't be arsed to find the relevant FG thread at the moment). Anyway, yeah, land of the freely taxed. And the Patriot-Act-era level of integration between the IRS and Customs/Immigration is really pretty spooky.

It's still on the back of the tax customs declarations, so I imagine it's still enforced, all though I'm not sure how they come to know about the money other than the drug sniffing dogs.

They do sometimes ask if you are carrying more than $10,000 cash, to which I almost always reply "I wish".

Ah, I didn't mean quite that way. Customs will automatically seize more than $10k if it is undeclared. I'm not sure what they would do if you have $9999. Outside of customs I don't know if there is any lower limit at all... It seems to be that if you have a lot of cash it is automatically subject to seizure at the whim of the officer involved.
