Dealing with damaged baggage

Sorry if you were hoping to hear about a lemur with daddy issues, I'm literally talking about damaged baggage.

Last ANA flight from LAX to Narita saw 3 of 3 of my suitcases destroyed. 2 of them being brand new and fabric, had tears, holes, and pretty nasty dents on the frames. The third one was a plastic shell type and was either crushed, dropped, or thrown so hard that the area around two of the caster wheels cracked inwards, rendering it pretty useless. The contents were heavy, paid quite a bit in excess weight and additional baggage fees, but the worst part is that one of the pieces of merchandise in it went missing and 2 pieces were damaged beyond repair. TSA did inspect one bag but it's contents were all there and intact. The worst damage occurred with the bag that contained the 2 pieces that were damaged. Carry-on sized so who knows how they did what they did but it was obviously punctured and that looks like where the damage occurred to the contents.

Apparently ANA subcontracts out the luggage handling at LAX so the freight monkeys there are likely to blame for this and others baggage being damaged but it still leaves ANA responsible for the damage that occurred.

After a bunch of paperwork, phone calls, shipping, and gomen nasai's from ANA, they are replacing 2 of the bags and attempting to repair (should be interesting) another. Ok, sounds reasonable....but then in regards to missing item, "can't find it, sorry, we won't do anything for you." :rolleyes: In regards to the damaged items, "we can't determine how they were packed and since we didn't do the packing, we can't be held responsible" :mad: and as to all the extra baggage fees, despite the condition of everything, "you were charged the right amount, we cannot refund these fees." :wall:

Mind you, the merchandise in question are billet steel car parts, not cheap and not easy to damage. I would have carried them on but TSA didn't like them in my carry on so into check in they went. I have dated receipts for everything that show value and proves condition was new. So...I just sent a demand letter to ANA's US customer service rep for the value of the 3 merchandise plus the retarded baggage fees they still feel they're owed. Have a feeling it might be a fight but being just slightly south of $5k, it would be a cheap/simple small claims court case to file...can't see how I could lose either...3 of 3 of my bags were destroyed and have ANA's own admission of other customers on the same flight having the same type of damage issues.

I'm no newb to court, have yet to lose a case yet, BUT I've never dealt with this type of claim before and there may be factors specific to this type of thing that I'm unaware of so I would appreciate anyone's experience or advice.

My advice - never give up. Keep following up and being a pain their their arses. Keep hounding them and drown them in paper.

Eventhough they will try to blame the subcontractors - your contract was with them so they need to be responsible for THEIR subcontractors actions if they resulted in the damage.

That is if you are in the right..... if they can pull some shit about being inappropriate types of baggage then you are screwed.

1 of 2 of mine were destroyed from the *domestic* leg of NRT->LAX-> San Jose. Some teeth pulling, but I will get some dough back when I drop the shit off. They really must have gone out of their way. Looks like they dropped a bowling ball on it.

Been on them like a bad case of stomach flu since this began (politely of course) but they don't seem to want to negotiate or discuss it other than report thier group think conclusion to their "investigation." Last guy I spoke to on this side made it pretty clear the LAX side was who was calling the shots so I told him to make sure they knew I was not going to accept them trying to weasel out of their liability here and will be going after them in court if necessary. (and like I said above, I plan to follow through) They actually have the damaged car parts in their possession right now and are totally aware of what they are and the value, nothing has been said about inappropriate luggage or the value so if they switch to that story later on, it'll just look like one excuse after another to the judge. My guess is they may play tough until they get served for the court case, I can't see them actually fighting me in court over this, but who knows how stubborn they want to be.

LOL, any pics? I've seen luggage get damaged before but this time with my stuff was pretty insane...punctures, slashes, dents, crushing.

Are you friendly with a J lawyer? Get em to write one of those letters that suggests action very soon or the matter will be taken further. Seems like classic Japanese evasion tactics - I agree with Gomi Girl about getting in their face and I know you're doing ya best but here the official letter from a person in a profession like law might shake em up.

I wouldn't count on the repairs being any good. The best thing to do is get them to make a commitment to solve the problem at the airport. Don't leave until you do because you'll waste even more time dealing with them as they won't be under the pressure of finding a solution quickly to get rid of you so they can get back to work.

Taking photos of your luggage there, in front of them, speeds things up.

That's my experience at Narita. You'll get better results angrily waiting for a solution at the airport and the eye candy is better.

I visited California with a Japanese friend last April. We flew back from SFO.
The day after arrival, she unpacked her bag and found that some omiyage was missing, and a note saying her bag was inspected mixed in with her stuff.

Here's were the pain starts. SFO has a private company doing security, named Covenant if I remember correctly. On their website it says to submit any missing item claims with receipts showing the cost of the items. I did this, thanks to my friend being diligent and keeping every receipt. I had bought the same omiyage, so I also took pictures of my stuff as an example and included that in my request.

Several weeks later I get a letter denying my request. They claim that there's no way to identify if the items were taken during inspection, or if a baggage handler with the airlines took something.

My response, I requested the video of their inspection. On the note it said every inspection was video taped, so I wanted to see the inspection before accusing the airline of foul play. No response from Covenant.

So I look up the airport information and email management. I include everything I submitted to Covenant, and explain that I will tell all of my family and friends to never use their airport again if they don't do something about Covenant denying my claim.

One day later I get an email from airport management saying they will look into the issue, and apologizing for the inconvenience.

A day after that, I get an email from Covenant saying a check is on the way.

Moral: Go through standard methods, but be ready to escalate things to higher levels.

P.S. In the last Covenant email they accidentally included prior emails from everybody, including airport management and the TSA administrators. The only message from TSA to Covenant was the diplomatic equivalent of "What the fuck is going on, and why am I being bothered with this? Fucking fix it yesterday."

Will do, I'll e-mail them a copy of the service papers (in addition to proper service of course) and let them know the details of how they're handling this situation are being made very public. Who knows, maybe they just need some more motivation...

I've got a friend who used to work for UPS and now works for a smaller logistics company. He said the worst place in the US for pilfering at airports is NYC. Having gown up there that didn't surprise me at all.

Worst time was when I flew in to Atlanta...all kinds of weird small things missing. Was too busy and it wasn't enough to make me take the time to complain but damn it was weird what they took.

Like that time I got drunk and blacked out. I woke up in the street and someone had robbed me. My wallet and watch were gone which I expected but they also took my tube of Vaseline lip care. Really strange. Why would someone want that? Did I mention I was drinking in 2-chome and for some reason my asshole was killing me for the next few days.

Oh mosdef keep anything of value in your carry on. Especially medications. The TSA will target cases that are brand new looking, or have a frequent flyer tag of any middle eastern airline (i'm an emirates gold...any flights i take to the yoo ess of ahhh where i forget to remove my gold tags will end up with the 'your bag was randomly chosen for inspection...'), or have a tag with a non-american sounding name and address.

am very glad to hear someone has fought and won with them. i had someone along the route from SAS help themselves to an ipod nano that i'd bought in nyc last year. when i tried to claim it in copenhagen, i was told that they couldn't help me because i didn't declare it for duties. fuckers.

Why not just say it was personal effects you had from before?

I guess an approach to ward them off might be to put a gigantic cock & balls sexual contraption in there. Maybe in a plastic bag w/ some goo on it. We actually did this to a colleagues carry-on (they ran it through security twice). Embarrassing, yes, BUT nobody opened it.

Personally i put the precious stuff with dirty underwear... and after few days in fureign mostly tropical country with unrully tap water I'm surprised not to have received requests for samples from the CDC... Just have to check carefully to have sorted everything before burning the laundry bag...

was still in the box. and as i had my iphone, ipad, computer, and a 2nd gen ipod touch, they weren't buyin the story. with huge VAT here, there's a lot of people who bring stuff back from the states for others. nevermind.

i definitely like the put something squishy and phallic into a bag idea. that'll be fun for my next entry into KIX!
