Japan court says requiring same surname in marriage is legal

Japan's Supreme Court ruled Wednesday that requiring married couples to have the same surname is constitutional, dealing a blow to a longtime effort for gender equality in choosing names.

The law does not say which partner must give up his or her name in marriage. In practice it has almost always been the woman who took the husband's name. Some women say that is unfair and they feel as though their identity is lost.

In traditional marriage, one person, usually the woman, enters the household of the partner and is registered as a member of that household. Men are seen as more powerful in Japanese traditional culture. But as women increasingly have careers, some argue that changing surnames is confusing.

In a separate case, the Supreme Court ruled that prohibiting women from remarrying for six months is unconstitutional.

The thinking behind that requirement was to prevent a woman who was possibly pregnant by one man from marrying a different person.

The court said that was outdated because of advances in science, such as DNA testing, that provide proof of the biological parent, Tomoshi Sakka, a lawyer for that case, told reporters outside the courtroom.

"The policy degraded women, and this is a step toward gender equality," he said.

The court found that a ban on remarrying exceeding 100 days was excessive. Sakka said he was optimistic that the change would be extended to less than 100 days in parliamentary discussions.

this point was already discussed among j-intellctuals a long time ago.
kimche version separate surname is not a effect from feminism but one from extreme female discrimination(complete-oppositely! :mrgreen: ) deriving from their traditional family system in which woman is not regarded as a member of the husband family and woman is nothing more than a "birth machine" to give her husband family a son.

Is it just me or is obsessively comparing Korean society to Japanese like me comparing Canada to, well, ........Romania or Burundi? I find that funnier than how fucked up his logic is about the right to choose your own surname in a developed country.

For kokusaikekkon the woman has more freedoms. My wife took a double name consisting of my family name followed by her family name, as to the Dutch tradition.

Under Japanese law the children will be given the family name of the woman, so my kids have a double name. Sometimes confusing, since some Dutch now assume that my 13 yo daughter is already married, and my son is female and married too...

I don't really find it as degrading to women, hell, if there are no sons, often time the husband takes the wife's family name....but the jiji/baba "if they don't all have the same family name, how will we know they're family?!" mindset that has gone as far as to be legislated. LOL reminds me of the horror the locals experience when a furriner tells them they don&t know their own blood type :roll: "but but but how will the doctors know what type of blood to give you?!" :-D To which their foundations may be shaken with "what if you're not conscious?? They do the same thing....check your blood, not take your word for it."

Well, it's 96-4% women over men, so that does suggest an asymmetry not being addressed. Like you said though, the problem is that it is legally enforced. Most would still choose to share a name because most believe that's important, which is nice, but the ones that would rather not shouldn't have to, and shouldn't have to resort to clever back door fixes like the Registered Legal Alias trick they use to keep their maiden names for work. Once a woman is out of furry boots and cosplay wearing age she has an identity that includes her own name. As you noted, lots of people need to be told to FO and mind their own fuckin busybodiness, and this is a perfect and very worthy opportunity. The ones that really get me are the Troglowhite FGs that vehemently insist their wives change their name to Glockenspielenmeister, or even Arudou. Or give their born and raised in Japan children goofy Western Heritage Names because it was their hillbilly granpappy's baptismal name, or some such crap. That's just cruel narcissism.

BTW, I don't know my blood type either. It started out innocently enough, but now it's a mission. Just Say No!!!!!!!! :biggrin2:

Japan Study: A Third of Working Women Were Sexually Harassed

A Japanese government study has found nearly a third of working women who responded to a survey reported being sexually harassed on the job, such as being subjected to unwanted physical contact or degrading comments.

The study, released Tuesday and the first of its kind, examined responses from more than 9,600 women employees, submitted by mail or online. The response rate was 18 percent. It did not give a margin of error.

Of the respondents, 29 percent said they had suffered sexual harassment. The most common type of harassment was having their appearance or age become the focus of conversation, at 54 percent.

The next most common was unwanted touching at 40 percent, followed by sexually related questions at 38 percent. Twenty-seven percent were asked out for meals and dates.

Japan trails much of the world in achieving gender equality, ranking 101st among 145 nations and economies in the World Economic Forum's study on the "gender gap," which measures how fairly women are treated based on economic, educational, health-based and political indicators.

Serious question: Is asking someone out for a meal or date really sexual harassment?

Assuming that both parties are single, of course. I understand that touching and lewd comments can fall into that category, but asking someone out?

Are coworkers taboo or something? And if so, since when? I would have thought that the correct response, which would apply outside the workplace as well, would simply be to refuse and be done with it. Unless there was some sort of power harassment involved too (as in, "if you want that promotion, you'd better agree to a date" type bullshit), just saying "no" seems to be the solution. Whining about sexual harassment just seems really ... fucked.

Or am I getting really old and out of touch?

Japan gets the message as working mom’s complaint goes viral

An anonymous blogger triggered the controversy with an angry rant last month about her failed quest to find day care. The author said she had no choice but to quit her job to take care of her new child, and she gave the post a provocative title that roughly translates: “My child wasn't accepted at nursery school. Die, Japan!”

The message spread quickly across Japan’s active social media and jumped to the mainstream news media, as well.

Although Abe has said he places a high priority on creating more opportunities for women in the workplace, only about 30% of women return to work after giving birth.

The online post soon made its way to Japan’s parliament, called the Diet. Instead of addressing the day care issue, Abe and his supporters focused on the anonymous author, inferring the post couldn’t be trusted.

"Since it (the blog post) is anonymous, there's no way to tell if it's genuine," Abe said during a Feb. 29 Diet session.

That’s all it took: Hundreds of picketers immediately showed up at the Diet building, carrying small children and signs proclaiming “Watashi da” — “It’s me!”

The catchphrase caught on, and a petition demanding better day care got 28,000 signatures in just four days. It was presented Wednesday to Japan’s labor minister.

OTOH, why would soemone breed kids, just to dump them off in a daycare for someone else to take care? When I get myself a dog, then I take responsibility for it and not chuck it into a kennel for someone else to take care. Every responsible dog-owner would do this, why not the kid-owners?

There are surely enough people on this planet already, overpopulation is just as bad as with cats. We should have spay/neuter programs for humans, maybe sponsored by seven-eleven? Two free rice-balls for your balls :lol:

I recently got married and that has basically been the rule - just don't talk to most women.

About daycare - at least here in Osaka I know people where the mom stays at home and the kids still go to government daycare, so it's not entirely impossible.
