Japan sounds out Jenkins to come to Japan for medical treatment

...Tokyo is seeking Washington's cooperation in the matter behind the scenes, they said.
Jenkins has reportedly refused to come to Japan due to fear Japan will hand him over to the United States for a court-martial under a bilateral extradition treaty. He is said to be ill and has recently undergone surgery in North Korea.
The treaty has no clause to limit extradition of a culprit under treatment, but whether to actually hand a suspect over in such a case is often left to a judgment of circumstances, the Foreign Ministry said. Persuading Washington should be possible in that sense, according to the sources.
Japanese doctors who were sent to check Jenkins' condition have concluded that he needs treatment in Japan, and the government is considering a hospital in the greater Tokyo area, the sources said.
One government official said Washington is unlikely to request a handover if Jenkins comes to Japan for medical treatment, "based on common sense."

For several reasons

From a personal point of view, I, in the somewhat not too distant future will approach that old buggers age, I certainly haven't gotten, nor expect to get, a hero's welcome from the fine people here.

From an American government point of view, consider for a second what the Japanese government reaction would be if,say, London or Paris give refugee status to the bunch of Japanese Red Army terrorist who are hold up in N.K. wanting to return home.

From the point of view of an FG, the problem is that letting Jenkins into the country creates a horrible double standard. There are thousands of far more worthy people trying to get into this country.

Finally, the only reason that the government has been so sympathic is because they see it as a vote winning issue, and trust me, they won a few seat more then they should have due to it. So who benefits be letting him in? Those horrible conservatives.

He and his daughters were shown filling out a one page entry form at the airport. He says he is " North Korean citizen" so they must have N. Korean passports, probably diplomatic ones.

The Japanese government has decided to bring Charles Jenkins, an accused U.S. Army deserter and the husband of a repatriated Japanese abductee, to Japan as early as Sunday for medical treatment, government sources said Wednesday night.
The sources said Japan has decided to help Jenkins visit Japan even without an agreement from Washington to prevent his extradition.
Jenkins has expressed his willingness to visit Japan, Japanese government sources said, adding he has also said he does not want to return to North Korea.
Government sources said earlier in the day that Jenkins is willing to travel to Japan as he is confident that Prime Minister Junichiro Koizumi will enable his family to live permanently in Japan.

The government has decided to bring Jenkins to Japan even without an agreement from Washington because officials believe Jenkins requires medical treatment in Japan soon, the sources said.
But the officials believe that securing such agreement on humanitarian grounds from Washington before bringing Jenkins to Japan would be difficult, according to the sources. Tokyo apparently believes it can avoid handing Jenkins over to the United States if he is in Japan for hospital treatment....
Koizumi also said the government aims to enable Jenkins to live in Japan permanently rather than make a temporary visit for medical reasons.

On NHK TV's 7pm News last night, an American laywer was saying Jenkins could only be held for 72 hours and released on the lack of evidence. (Since the Army lost the evidence, there's no way to prove the fool-traitor defected.)

....According to a mutual security pact under which more than 50,000 U.S. troops are stationed in Japan, U.S. military police have the power to seek out military suspects and arrest them, whether they are on base or off, sick or well.

But Eddie-Callagain stressed that very little is known about the Jenkins case and desertion is a hard charge to prove. "They have to prove that at the time he left, he never, ever intended to come back," she said. "That's very hard to do."

Unless the military is confident it can prove he did not intend to return to his unit, it may charge him instead with simply going AWOL ---- absent without leave. Or they may find that he never wanted to leave at all, and --- like his wife --- was forced to remain in the secretive nation....
If they find he did desert, he also could face a host of other charges, including aiding the enemy.
But the military justice system allows for a wide range of punishment options. A guilty verdict could mean life in jail, or virtually no punishment at all if there are significant mitigating circumstances.
"The military court will take all that into consideration," Eddie-Callagain said. "But the main thing is, he has to go through the process if he is ever going to get to the other side. At his age, he just needs to get this behind him."

U.S. Ambassador to Japan Howard Baker suggested to senior lawmakers of the ruling coalition Friday that Charles Jenkins, an alleged U.S. Army deserter to North Korea, should seek a plea bargain, officials said.
...Baker said, as his "personal opinion," that Jenkins should turn himself in, consult with a lawyer and seek a plea bargain on the charges against him, according to participants of the meeting.
Baker was quoted as saying that Jenkins "will not face capital punishment if he confesses to everything he has done."

...Jenkins is accused of four charges: instigating desertion, deserting service, helping the enemy and promoting abandonment of loyalty.
At a news conference, Hosoda said Jenkins' illness may be spreading to other parts of his body. Although Hosoda did not elaborate on the exact nature of the ailment, his comment suggests Jenkins is suffering from cancer.

Airlines bid 1 yen to transport American deserter


Japan Airlines and All Nippon Airways, the country's two biggest carriers, each bid a mere 1 yen for the right to bring back to Japan Hitomi Soga and her family, including accused deserter Charles Jenkins, the Mainichi has learned.

JAL was eventually awarded the contract when its name was pulled out of a hat because the bidders submitted identical prices for the flight from Jakarta to Japan on Sunday.

Cutthroat competition between the airlines has helped cut some of the exorbitant expense that has surrounded the trip to Jakarta by Soga, a Japanese abducted by North Korean agents, and her family -- Jenkins and their two daughters, who had been holed up in Pyongyang.

Chartered planes are only one luxury to have been showered on Soga and her family. The ministry had the family stay in an exclusive suite at a five-star Jakarta hotel costing about 200,000 yen a night. The government says it has a contract giving it the room for 50,000 yen a night.

I can't believe how much Jenkins is playing up his sickness for the Japanese media. When he got off the plane in Jakarta, he walked with no problem. No all of a sudden he needs a cane and stumbles. My god this is sickening to watch. And guess what folks it will be live Jenins-san for the next week 24/7, whether you like it or not. :roll:

Pulling a sickie is a time honored way for politicans to avoid prosecution in Japan, Tanaka did it during the Lougheed Scandal, Kanemaru did it during the Sagawa Scandal, so it is quite possible that he has been given that advice. :roll:

My wife just told me she red that the J-gov't is thinking about giving Jenkins citizenship thus protecting him from any persecution. I think its a mistake, let the US pardon him, then everybody will have that warm feeling in the pit of their stomache. But if Japan jumps the gun and makes him a citizen the US might just be a little testy. But its an election year so you don't want any kind of int'l incident do you.

At first I thought they should throw the book at that B. Arnold... but now I think they should just let him wither away.. He's tool old to prosecute, and there should be a statute of limitations on desertion.. like with many crimes in the US.

I think the US going after that old man will only make matters worse.. the way he looked on TV it don't look like he has that many years left.
