A British man was convicted on Wednesday by the Tokyo District Court for assaulting a karaoke bar owner who tried to stop him as he ran away from a whopping bar bill.
But the 24-year-old man, whose name has not been disclosed for legal reasons, will avoid prison after the court suspended for two years the three-month sentence it had handed down to him.
"The defendant did not actively initiate the violence and his intention to flee was not particularly strong. He simply became involved in a scuffle," Kawaguchi said, explaining his decision to suspend the sentence....

There were six guys involved in this and, by their own admission, they did act like idiots. The original charges against this one guy involved criminal damage as well as robbery and assault - taken together the sentence could have amounted to seven years in the clink. Apparently, if you are guilty of charges which carry a combined sentence of over five years, some jail term in Japan is mandatory. The prosecutor decided to pin the three offences on this one guy but it became evident that, while he had attempted to run away without paying, he had tried to stop the fight that broke out and hadn't damaged the property.
It was looking pretty grim for him and he spent a few months in jail waiting for trial until the prosecutor dropped the criminal damage charge which got him out on bail. His defence team were pretty certain that there was no evidence against him on the assault charge so this result seems to have been their best case scenario.
Not a pretty episode.

Dang. This could have been me on many a "fun" night with my judo sensei.

Many times we were given a "whopping bar bill" (100,000+ yen) that was WAAAAAY out of line with what we consumed. He would just dump the ALL contents of of wallets and pockets on the bar and gently slide/shove our way out. Several times bar owners would hit the shop's rolling shutters trying to restrain us and keep us on the premises till the cops came. We had many "not pretty episodes" down in the buta bako/policebox but we always managed to talk our way out.

(PS: You must have had a pretty good episode with Mr. Sparkle taking him drinking last Monday from what he said. Good job! :P )

I may look stupid for my reply but doesn't it mean that he only has to do the time (3 months) if he's naughty again sometime in the next two years? Otherwise, he's off scott-free (or whatever his name is).
