Japan Times: Foreign mothers fight for children's futures
Rosanna Tapiru...has two daughters, 7-year-old Masami Tapiru and Naomi Sato, 3, both of whom were fathered by a Japanese man. However, due to a little-known article in the Japanese Nationality Law, while Naomi may claim the rights and privileges of Japanese citizenship and the protection that it affords, Masami cannot. please clarify:
The first daughter was born before they married and thats the problem?

In order for the child to obtain Japanese citizenship if the couple is not married, the father must give "ninchi," or recognition, that the child in the mother's womb is his own.

seems fair enough considering anyone could come along and say they "had a japanese father their kids and now hes run off and they cant find him" - BAM, give me citzenship!

Well, I'm sure there are plenty of cases where guys do knock up hostesses and then run off. If, as this article seems to say, you need the father's cooperation to establish citizenship, this is a no-win situation for the mother and her kid. This law makes no sense in the modern era when DNA evidence can be used. I wouldn't count on the courts to recognize DNA evidence if it conflicts with the letter of the law. Even if a judge thinks the law is wrong, he might be compelled to follow it. I'm not sure how much freedom Japanese judges have in bending laws to fit a specific case.

Rosanna Tapiru's problems really began shortly after her arrival in Japan.

Filipino Rosanna Tapiru is fighting a legal battle to secure the futures of Japan-born daughters Masami (left) and Naomi.

She came here from the Philippines to make and save money, but her dreams of a better life for her family were, she says, "washed away" when her partner, who remained in the Philippines, left her for another woman.

Forced to move on, she sought to rebuild her life -- and hopes for a family -- in Japan.

"Such a simple dream," she exclaims, though turning it into reality has proved to be next to impossible.

Tapiru now has two daughters, 7-year-old Masami Tapiru and Naomi Sato, 3, both of whom were fathered by a Japanese man.


Foreign mothers who have filed a lawsuit challenging Japan's Nationality Law meet in Tokyo to discuss their plan of action.

However, due to a little-known article in the Japanese Nationality Law, while Naomi may claim the rights and privileges of Japanese citizenship and the protection that it affords, Masami cannot.

Article 2 of the Japanese Nationality Law states that a child is entitled to automatic Japanese citizenship if, at the time of birth, it is certain that either the mother or the father is a Japanese national.

The clause is straightforward enough if the mother is Japanese, or if the couple is married.

However, difficulties can and do arise if the couple is not married, and particularly if the mother is not Japanese.

These cases are on the rise as Japan reluctantly begins to open its doors to foreign workers.

In order for the child to obtain Japanese citizenship if the couple is not married, the father must give "ninchi," or recognition, that the child in the mother's womb is his own.

Ninchi may be given after birth and the child registered on the "koseki touhon," or family register, but in such cases, it is almost impossible for the child to obtain citizenship.

Japanese courts have begun to stick to the letter of the law -- in this case stipulating that recognition by a Japanese father must be given before or "at the time of birth."

If ninchi is given after the birth, the court does not recognize that the child had a Japanese father at the time of birth, and therefore rejects the claim for citizenship.

The only way for the child to gain citizenship and a passport is for the parents to marry, which is highly unlikely if they haven't already, or to wait out the lengthy and arbitrary naturalization process, originally intended for adults immigrating to the country.

Even in the case of adoption by a Japanese father, citizenship can still be unattainable.

Tapiru, having learned from the birth of her first daughter, was sure to get the ninchi in time for the birth of her second.

However, she worries about the future of her children. As the primary caregiver of a Japanese citizen, she is permitted to stay in Japan on a permanent residence visa.

However, if something were to happen to her, one child would be cared for by the Japanese welfare system, while the other would have no such claim, and in all likelihood would be deported to a country where she would be unfamiliar with the language, customs and way of life.

That is just sending a child off to die for the crime of not being pure blood Japanese. Even though the child speaks Japanese , only knows and understands Japanese culture and is Japanese by every standard except the ancestry of her mother they will send her to die in a third world gutter rather than have their precious Japanese purity diluted that much further. I've heard of some racist things in Japan but this is the most cold hearted yet. This would do the KKK pride. It makes me ashamed that my tax dollars pay the salaries of the ignorant racist hateful bastards. How they could do that to a child, one of their own, even though they are too blind with hatred and racism to see that, is beyond me.

Tapiru's children currently attend the same school, and "nosy" questions from teachers about the children's parental status "pushed me" to do something, she says.

Tapiru is one of nine Filipino women who stood jointly before a judge in a Japanese courtroom on July 15 to request that the court grant full Japanese citizenship to them and their children.

The court heard four cases, and is scheduled to hear the other five in September.

As the women read their statements in Tagalog, later to be translated into Japanese, they struggled to remain composed.

For all, this case represents the final chance for the future security of their children.

All the children have Japanese fathers, but, due to the Japanese judicial system's strict interpretation of Article 2, do not hold Japanese citizenship or passports.

In addition to the bullying at school that results from the children having katakana and foreign-sounding last names, they must deal with the insecurity of their futures.


As they are not of a legal age to care for themselves, their residence status relies solely on that of their mothers.

"He has a Japanese father, and a Japanese mind," says Olivia Ligon, one of the nine mothers, of her 10 year-old son Rafael.

She says discrimination stemming from his lack of citizenship will hold him back from living a full life in Japan.

He is on the "koseki touhon" (family registry) but doesn't have citizenship or a passport.

"I have lots of friends. My mom works hard. My father is Japanese. He calls me on the phone to tell me to study. What am I?" Julia, Charlette Chieeum's young daughter, asked the court.

"I am Japanese," she answers.

Although the women hope that their strength in numbers will call attention to their cause, they remain realistic.

While they are aware they may lose the battle, they are prepared to take the war all the way to the Supreme Court, a process that Tapiru and Mio Tanaka of the Japanese-Filipino Center, who is assisting the mothers with their case, estimate may take as long as five years.

"This is a landmark case," says Tanaka. "It goes to the heart of Article 2 of the Japanese Nationality Law, one of the basic laws of the land."

Cesar Santoyo of the Center for Japanese-Filipino Families estimates that there are between 60,000 to 80,000 Filipino women coming to Japan each year.

As the stagnating economy and falling birth rate have led to calls for more immigration, handling even the present immigration population is proving difficult for the Japanese government.

Attention desperately needs to be called to immigration and citizenship issues, in particular the implications of Article 2, says Tapiru.

"Most Japanese don't know about this," she says.

"I want to let the Japanese know that they have this strange law."

Tapiru and the other mothers have come in for some criticism from those who believe their case is designed primarily to secure the benefits of citizenship for themselves.

But Tapiru rejects such claims.

"This is not for myself," she says. "This is for the sake of the children."

And the case is exacting a financial as well as mental toll.

To offset the costs, with the help of the Nishi Kawaguchi Filipino Network (KAFIN), the Japan-Filipino Center (JFC), and the Center for Japanese-Filipino Families (CJFF) the women have sough to raise funds through selling raffle tickets, holding talent contests, and other activities designed to raise awareness as well as cash.

The base of all this activity is the KAFIN office in Nishi-Kawaguchi.

Founded in 1998 by Agalyn Salah Nagase, KAFIN acts as a lifeline for Filipino women in Japan providing counseling, language lessons, information on legal matters and sometimes a refuge from abusive spouses.

But "most of our clients come for child recognition issues," says Nagase, who estimates that KAFIN fields at least 7 to 10 phone calls a day from Filipino women throughout Japan.

"If we just stop and observe," says Nagase "nothing will happen."

"But for the solution to Tapiru's problem, all she can do at the moment is wait and hope."

"I want to succeed this time," says Tapiru.

"This is not only my dream. It is a dream for the next generation of children. If we don't win this case, I will be very sad. My dream will wash away again

But no matter who the father is, if a child is born in Japan and only knows Japan, Japan should have the pride, dignity and decency to treat her or him as one of its own. Ditto! This is what should happen. Unfortunately Japan thinks that poor illegitimate children born of even one Japanese parent should be evaluated on the merits of their contribution to society. If the foreign mother becomes incapacitated and unable to care for the child, Japanese authorities think the non-Japanese child should be sent to another country (any country) rather than be on the welfare roles in Japan. This is better for Japan, (not the child of course). If foreign workers contribute more than they take from Japanese society they will be allowed in to stay. If they are judged to be more of a burden (financially or even emotionally for the native population) they will be sent back or furthered on to a more acclimating country (maybe Canada). Japan is saying "We will take foreigners UP TO A POINT, the point being what is percieved to be good for Japan. Selfishness as god.

As for judges, they are allowed to intrepret the law within very narrow bands. If the law is quite specific and clear, they have no choice but to make a ruling based on the merits of the case within the confines of the relevant laws. Lot's of bad judgements go down but this is usually the fault of the law itself, not the lack of common sense in the judge. Privately many judges complain bitterly about this and that aspect of laws and the court system in this country, but they have very little choice in making most decisions they make. This is not an excuse though for the lack of social justice in Japan, just the reality.

I'm guessing this is a case of judges' hands being tied by a bad law. Of course most of them are probably conservative nationalist pricks who actually have no problem with the law. The idea of deporting some poor kid to a country they don't know to live with people they may not know if something happens to his mother is just fucking sick. Anyone ever heard of this actually happening?

DNA evidence doesn't always trump law. Do some searches on California paternity cases and you will see how bad men are being fucked there no matter what DNA evidence says.

WELL SAID

This whole law is about "purity" of bolod line(the real reason japan went to war btw). japanese all know what blood group they are, they believe in blood lines and purity of race.

1. due to rote learning they are basically socially/politically stupid
2. due to media brainwashing they are basically all ultra nationalist
3. due to media brainwashing many are xenophobic
4. japanese don`t really give a shit about anyone else but japanese

japanese living (often born overseas) that commit crimes often come running back to the motherland and welcomed with open arms..by "family nippon" they are always considered japanesese (a child returning home)

they are too brainwashed (dumb) to realise nationality is about where you born, the language you learn, culture you are exposed too etc. and not your parents blood.

I know many japanese born overseas they arent considered "foreign"

this is why Japanese/koreans even third generation MUST carry "GAIJIN CARDS" just like you and I.

I don't know who made this statement that BC is quoting (if BC didn't make it).
If anybody out there is or knows of anybody who is in this sort of situation, (besides the woman in the article) drop me a line on the PM, I'll do something about it.

Wow, BC do you feel better now? That was a hard charging post. Where I do agree with the general thrust of it, I think you are again being a bit to wide sweeping in pointing the finger! Just a few comments.

That surely does exist, but I wouldn't say they all believe in that! There are many FG's on this group who are married to Japanese who don't. My personal rice cooker has produced five muggles and would argue with you about your collectiveness on that issue.

Again, you identifying them all with a group that publically espouses this and neglecting those who don't get the publicity for their views (media bias).

The flip side to that is if a J type committs a crime overseas that is a violation of Japanese Law, they can be tried in Japan for the offense. There is no legal situs of an offense as in the USA or other countries. The problem comes when the offense is either not a violation of Jlaw or is to vague, they will not prosecute (or extridite). Granted there are many exceptions, but only the ones that piss us off the most get published in the media.

This is not correct. Koreans are as entitled to apply for citizenship as anyone who is an FG. Oviously, they should not have to by right of birth, but a lot of this has to do with parents and grandparents refusing to give up their own identity and citizenship from Chosen. Stateless as they maybe. There are blocks for some to obtain citizenship, but most can if they wish to apply. Most do not so desire.

OK, I'm married to a Japanese woman and have two children: both were born in Japan and both have Japanese citizenship. Even with my gaijin blood in them. Why? Think about it.

This is clearly not just about "japanese blood". If these chicks would have been married, their kids would have been automatic japanese citizens. No change in the blood, big change in their legal status. It's pretty damn simple.

One can debate the rules for citizenship, and even hope that countries such as Japan and Germany and others with similar citizenship criteria, instead change to a system like USA based wholly on where one was born regardless of their parents' status.

But in the meantime, the easiest way to protect the rights of kids and improve their lives is to tell foreign women in Japan to stop getting knocked up out of wedlock or by men not willing to accept the children as their own. That's something that should be easier to accomplish than changing centuries old concepts of Japanese citizenship.

slim, it is about racial purity. They're just looking for any excuse what-so-ever that they can get away with on the international stage. This issue is all about racism and sexism. And it's very ugly. Sure mom would be better off not getting knocked up by some asshole. But to use that as an excuse to expel a child with no other culture than Japanese because of her or his mother's ethnic background??? It's indefensible. Don't insult yourself by anyway agreeing with this kind of hateful racism against the most innocent victims.

Actually, the law used to be worse. If a Jguy was married to an FGG and divorced her, any children of that union were JN, but if a Jgal married an FG dude and divorced, any children of that union were not Japanese. They could remain in Japan with the mother but were not entitled to enter public schools, health insurance, etc. The law was changed in about 81-82 to equal this up.

But this is again, marriage and/or divorced as compared to out of wedlock.

You are being disingenuous. It's not just because of her or his mother's ethnic background. It was also because she chose to not be married before having kids, or chose to have kids with a man who wouldn't sign one simple piece of paper that would grant the kids permanent citizenship. You can say it's for "racial purity", but whatever it is for, Japan's system grants citizenship to the children of any japanese woman and then to the children of japanese males if the father wishes to grant them such citizenship. Doesn't sound too horribly exclusive to me.

It's indefensible. Don't insult yourself by anyway agreeing with this kind of hateful racism against the most innocent victims.


If the law was changed as some are advocating here, the kids would have citizenship regardless of how long they had been here or what other culture or ties to another country they may have. That sounds equally ridiculous to me. I'm all for a system that will allow appeals so that cases can be decided on a case-by-case scenario and citizenship granted to kids who suddenly become orphans after living here their whole lives. Sure, sounds great. But I simply don't see the need to hand out automatic japanese citizenship to the children of unwed non-japanese mothers who only came to japan for temporary work reasons.

If we are to allow nations any right to their own sovereignty, the right to decide for themselves who can be considered a citizen of their country should be the very first right their sovereignty affords them, no? In other words, it's nobody's business but the japanese. And it should be one of those Voltairian moments where one can personally disagree with the way japan decides it's citizenship rules but still support their right to make that determination themselves as a unique, soveriegn nation.

In other words, I implore you to accept that citizenship rules are for the Japanese to decide for themselves, and for everyone else who chooses to live and breed in Japan to just understand and follow.

But just as a child shouldn't be punished because his mother got with the gov in a disco (and wasn't on birth control and didn't take the morning after pill or have an abortion), why should a child be rewarded with japanese citizenship just because his mother got with a j-dude in a disco?

The line has to be drawn somewhere. Some countries allow birthplace to determine citizenship. Other countries have other criteria. Japan's criteria isn't all that unreasonable to me. It's not like they are the only country to not grant citizenship at birth. The cambodian chick's kid wouldn't be given German citizenship if this disco had been in Berlin. Many other countries also have residency requirements before granting citizenship or base the decission on the status of the parents. I suppose all these countries are racist?

Just to be clear, nothing in my position would warrant an older child being returned to cambodia or anywhere else if they've grown up in Japan. There should be an appeal process where compassion can be shown and the citizens of Japan can be put on the hook for supporting this child if s/he has no mother or other family to do so. This process should be available to kids who weren't even born in japan but were brought here by their now-deceased mothers/fathers. They wouldn't have citizenship either, but should be allowed to stay if they have no other options.

In Ireland, during the last few years, all of a sudden we were getting large amounts of African (mostly Nigerian) and Eastern European women arriving heavily pregnant and shooting em out as soon as they arrived. I wasn't making an assumption - I was stating a fact. This is 2005 and we're talking about Japan. Women have complete control over giving birth or not giving birth.

The children may indeed be victims. But victims of their mother's poor judgement or victims of Japan's reluctance to hand out citizenship to anyone born in Japan? I suspect few people would agree with your suggestion that this violates basic human rights of all human beings. What happens to kids born to non-japanese mothers in japan is up to their mother, their father, her family, her home country, the kindness of individuals, and so on.

Criticizing the Japanese fathers who abandon support and a call for them to sign the documents granting them citizenship would be much more effective than calling on the rest of japanese society to grant citizenship and support for these kids that they had no part in creating.

I want to know if this statement is true: if something were to happen to her, one child would be cared for by the Japanese welfare system, while the other would have no such claim, and in all likelihood would be deported.

How much more effective? 70% more effective?

That's not unheard of around Nippon, or Asia, even the popular Agnes Chan, HK citizen at that time and permanent resident of Japan, left Japan to have her first baby in Canada. But, that was probably with more in reference to the reversion of HK, than citizenship problems in Japan.

Reversal: Nine kids with Japanese dads not citizens
The Tokyo High Court on Tuesday overturned a lower court ruling and denied Japanese nationality to nine children with Filipino mothers and Japanese fathers who are not married.

The Nationality Law says that a child born out of wedlock to a non-Japanese mother is only recognized as a citizen if the Japanese father admits paternity prior to the child's birth or marries the mother before the child turns 20. In the case of the nine kids, the fathers came forward after they were born but did not wed the mothers.


This is pathetic! If a J-father admits paternity before the child becomes an adult, then the child should have a right to J-citizenship. Why isn't anyone working to change this law?

"The children have no one in the Diet who will speak for them. The court was the only place that could grant the children's wish, but it refused," lawyer Hironori Kondo said...The government has also said the law promotes legal marriages.
