A veteran post office clerk has been dismissed on grounds of being convicted 27 years ago for clashing with police during an anti-Vietnam war demonstration... the 52-year-old man was stripped of his right to receive a pension although he had paid the premium ever since he joined... No severance pay was granted..

..he was dismissed because they could not employ a person who had been handed a prison sentence under the National Public Service Law.

Rules are rules, even after 27 years. 8O

Think "Goingu Posutoru" will become a common term in the Japanese lexicon?

Wait a minute... doesn't Japan have an ex-post facto clause in their Constitution?

Yes... they do:

Article 39: No person shall be held criminally liable for an act which was lawful at the time it was committed, or of which he had been acquitted, nor shall he be placed in double jeopardy

His former boss can now kiss his own pension goodbye... I hope the fired man gets a good lawyer. :evil:

As for il Postino, he is screwed.. because if he was handed a prison sentence and it is the law, Japanese will stick to it. Why? Because they are sticklers..

Do they not have a statute of limitations on things like this? 27 years is an awfully damn long time to dig back..

You'd think 27 years was a long time, but quite a few people a still living in a time warp.

A week ago, the lower house of the Virginia state parliament passed a bill which will require the flag of the defeated South to be hoisted in the state.

Shameful... truly shameful.
Why didn't they tell the man when they hired him that he couldn't reap the benefits of the pension. Hopefully he will sue the hell out of the government of Japan.
