MDN: Woman ordered to pay neighbor 2 million yen over noise pollution

NARA -- A woman on trial for causing a neighbor to suffer a sleeping disorder by playing loud music was on Friday ordered to pay 2 million yen in damages to the victim and her husband. The victim and her husband had demanded that Miyoko Kawahara, 58, from Heguri, Nara Prefecture, pay 3 million yen in compensation for causing the sleeping disorder. The Nara District Court said that the couple had argued with Kawahara over the parking of her car and excessive noise since 1991. Later, Kawahara played loud music, causing the victim to suffer a sleeping disorder. "It went beyond socially acceptable levels," Nara District Court Judge Akira Osawa said.

Oh man, that woman looks like a real piece of living hell. I just went through this kind of thing with an old woman neighbor who is hard of hearing. She would play everything super loud, and to top it off, leave her windows open (which are right next to mine) OPEN. The first time I came to complain, I was mister timid nice guy, and she was nice to me and the noise disappeared...for a month. Then it started again. I would be literally awakened from a dead sleep sometimes. The next complaint I wrote a letter. Noise calmed down for about 2 weeks, then started back up IN EARNEST, with reckless abandon (yes, I say, the abandon was indeed reckless in its earnestness). The last complaint, I jumped out of my bed half naked, no shoes on, and ran over there and lost my fucking mind in front of her door as she cowered behind her door speaking to me. Guess what, I haven't heard a peep in months. Sometimes freaking out is the only way.

Thing is, here in the u.s. I don't think you can force someone to be quiet even if you take them to court, so I had to freak out, because I was seriously thinking of just picking up and moving to another place (which would have really hurt me right now) .

Nara town seeks ordinance against 'noisy old lady'
Kyodo, Tuesday March 7, 9:21 AM The town government of Heguri, Nara Prefecture, proposed an ordinance on Tuesday at the municipal assembly aiming at stopping a woman known as "the noisy old lady" or others from disturbing neighbors with noise from their premises, town officials said.
...the town has been unable to stop Miyoko Kawahara, a 58-year-old local housewife, from making noise at her home night and day with her voice and music from a CD-radio-cassette recorder under current laws and ordinances for controlling noise from factories, on roads, and in some other public spaces....
...The proposed ordinance prohibits making noise of more than 60 decibels, about the level of conversation between the hours of 8 p.m. and 8 a.m. without due reason, and noise of more than 65 decibels in the daytime....
The ordinance does not carry any penalties or binding orders, however.

Mainichi: Noisy neighbor gets longer prison sentence after prosecutors appeal

The Osaka High Court on Tuesday scrapped a lower court ruling that sentenced a woman to one year in prison for harassing a neighbor with loud music, and extended the sentence to 18 months, ruling that that earlier ruling was too light on her. Handed the 18-month sentence was Miyoko Kawahara, 59, a resident of Heguri, Nara Prefecture. "The lower court ruling failed to grant that the suffering inflicted on the victim was intentional, and by evaluating it too lightly, the prison sentence given was too light," Presiding Judge Hiroshi Furukawa said in handing down the ruling...more...

Noise-maker arrested for harassing neighbor in Chiba

CHIBA — A 63-year-old woman was arrested Monday on suspicion of shouting loudly in front of her neighbor's house in Funabashi, Chiba Prefecture, nearly every day. Harue Ichikawa is accused of shouting such things as, "I will curse you to death," or "Get out of here," and making loud noise with a radio in front of the house of a 50-year-old man between early March and late May, according to police.
