The nation's four Internet provider organizations have agreed to forcibly cut the Internet connection of users found to repeatedly use Winny and other file-sharing programs to illegally copy gaming software and music, it was learned Friday. The move aims to deal with the rise in illegal copying of music, gaming software and images that has resulted in huge infringements on the rights of copyright holders. Resorting to cutting off the Internet connection of copyright violators has been considered before but never resorted to over fears the practice might involve violations of privacy rights and the freedom of use of telecommunications. The Internet provider organizations have, however, judged it possible to disconnect specific users from the Internet or cancel provider contracts with them if they are identified as particularly flagrant transgressors in cooperation with copyright-related organizations...Two years ago, a major Internet provider tried to introduce a measure to disconnect users from the Internet whenever the company detected the use of Winny or other file-sharing software. However, the provider abandoned the idea after receiving a warning from the Internal Affairs and Communications Ministry that such an approach was regarded as Internet snooping and might violate the right to privacy in communications. According to the new agreement, copyright organizations would notify providers of Internet protocol addresses used by those who repeatedly make copies illegally, using special detection software. The providers would then send warning e-mails to the users based on the IP addresses of the computers used to connect to the Internet. If contacted users did not then stop their illegal copying, the providers would temporarily disconnect them from the Internet for a specified period of time or cancel their service-provision contracts.


Just another reason not to use BitTorrent....

...I wonder how long it will be until unsuspecting people who don't secure their wireless will start complaining that they've been cut off. Or how about a hotel or small business that offers free wireless? Stupid ISPs.

So, if the Internet Providers were to start disconnecting violators, the Internet Provider would lose money by losing customers. Prognostication time: each ISP will sacrifice a few lambs once this new monitoring system is enacted, "Yes, we are complying with the laws to detroy illegal downloading which is worse than terrorism, starvation, etc." Then they will stop reporting "download detections" and peace and harmony will return to the world.

Actually I think you'll find that the ISPs are all for this. IIRC they must pay for all incoming traffic, so a heavy user on their network inevitably costs them more than whatever their monthly subscription cost is. Most of the time this is offset by the fact that the vast majority of customers use the internet to surf, check emails, and troll message boards (here's looking at you Take), so the loss is minimal. I heard this many years ago, but if the model still holds, then ditching those heavy users will be in the ISPs best interests.

Anyway, it's fucked. I hope they don't start pulling this shit though apparently it's happening already in the UK.

Mod edits aside, you can't use your 100mbit connection anyway. Heavy users get their bandwidth restricted. You'll note in the normal service contract it says "speeds up to 100mbps".

You have to shell out 2.5 times the money for a business account if you want "guaranteed" bandwidth.

I have noticed that speeds really do vary. I am often moving large chunks of data around between my office servers, my home and the bar. Fortunately none of it is mission critical so I am happy to wait - but still I have NEVER seen 100mbps from home - office on a business account is no problem.

There's actually a few ways they screw you over with the whole speed thing. Another is that if you use NTT's B-Flet's Hikari service, your service contract is for UP to 100mbps, but NTT does not provide routers capable of that speed. The highest throughput router they have is 90mbps, and you can't get it on a rental contract, you have to buy the router outright.

I've had up to 90 mbps communicating directly with the NTT backbone, but generally get much, much less any other time. Still noticeably better speeds than their ADSL service though (especially since I live next to a transformer station and can only get 2mbps through adsl because of all the "noise").

They have a business fiber optic plan now, with guaranteed bandwidth, but you have to pay 23,000 yen a month just for the NTT fee, not counting the fees to get your actual ISP to provide guaranteed bandwidth...

You'll also notice that because of NTT's insufficient backbone, every provider in the country tends to be slower at certain times (since everyone has to use NTT's lines), particularly early evening and weekends when most people are doing their recreational net use.
