Keihin Hotel Credit Crunched

The Keihin Hotel has sat across from the Takanawa exit of Shinagawa Station since it opened in 1871. The current building it occupies dates back to 1930 which makes it one of the oldest western-style hotels in Tokyo. It was seized by the Occupation forces after the war, and has survived several fires, but now it has finally closed its doors. The change in fortunes is being blamed on the failure of Lehman Brothers since a unit of the bankrupt investment bank, called Sunrise Finance, is a major creditor of the hotel. The story is a little more complicated, however. It appears that the hotel's president, Makoto Kobayashi, had decided earlier this year that he could see no way out of the 6 billion yen debt his company had run up. He entered into a contract with Sunrise who agreed to assume all liabilities in return for the hotel. Sunrise didn't want to keep the business going, so presumably they had their eyes on the real estate. Kobayashi then informed all his employees back in May that they were on notice. Their response was to form a union to protest the closure and were in negotiations to keep the hotel in business when Lehman Brothers went bankrupt. This put the assets in the hands of the administrator and effectively ended the talks. Kobayashi says that it was never going to be possible to keep the hotel open anyway and believes the bankruptcy is immaterial. The employees are continuing their protests, however. They took to the streets outside Shinagawa station on Monday to distribute flyers calling for support and have also applied to the Tokyo district courts for a temporary injunction. A union leader says that the hotel made a profit of 80 million yen last year and so ought to be maintained as a going concern. Kobayashi appears to be right that the closure of Keihin is not a direct consequence of the Lehman failure but it would help serve the union's purposes if it could be portrayed as such. A piece on their website (Japanese) describes the hotel being devoured by a foreign vulture fund.

ZakZak (Japanese) has picked up this story. The former General Manager of the hotel again complains that the hotel has been operating in the black and claims that the staff are suffering from the fickle management style of the owner. I can see his point but average annual profits of around 100 million yen a year aren't going to make much of a dent in a 6 billion yen debt. The liabilities were built up over the bubble period and the only asset they appear to be secured against is the land the hotel occupies. The hotel needed to find a buyer willing to assume the liabilities and refurbish the hotel (it hasn't been redecorated for twenty years) but no financial investor would be satisfied with such a poor return. The only person who would fit the bill is a wealthy patron who adores the place and there doesn't appear to be such an individual.

Kyodo: Court forcibly removes sacked workers who continued to operate hotel
Tokyo District Court enforcement officers on Sunday forcibly removed sacked workers who had continued to operate a hotel in Tokyo even after it was closed down in October last year due to financial difficulties. The situation arose after the original operator of the Keihin Hotel decided to close it down and fire its approximately 130 employees to pay back debts totaling around 6 billion yen to a Japanese affiliate of bankrupt U.S. investment bank Lehman Brothers Holdings Inc. Following the enforcement action, the dispute will move to the court where some of the former employees have filed a lawsuit seeking the nullification of the company's decision to fire them.

Shortly before 6 a.m. Sunday, the former employees and labor union members supporting them protested in front of the hotel, located near Shinagawa station, to prevent the district court officers entering the building. Scuffles with riot police accompanying the court officers broke out, but the officers entered the hotel at about 9:25 a.m. and finished the enforcement action around 15 minutes later. Around 200 workers and supporters had gathered outside the hotel but no one was arrested. A former employee, who fell over and hit his head, was taken to hospital. The former employees started operating the hotel and the restaurants in the hotel on their own a day after they were fired. On Jan. 15, the Tokyo District Court decided to order the removal of the workers so that the building could be vacated in line with a demand from the hotel operator.
