Southern Cross University law lecturer jailed

A JAPANESE law lecturer who bared her bottom to a judge will apply for bail pending an appeal against her recent convictions for threatening to kill court officials.

Megumi Ogawa, 41, was sentenced in March to six months' jail after a Brisbane District Court jury found her guilty of two counts each of using a carriage service to harass and using a carriage service to threaten to kill Australian Federal Court officials in 2006.

During the trial, the court was told Ogawa, who is a lecturer at Lismore's Southern Cross University, sent 83 emails and made 176 phone calls to Federal Court staff.

During some of those contacts, she made threats to kill registry staff.

Ogawa regularly had to be removed from the trial for incessant screaming, making disparaging comments about the justice system and wrestling with corrective services officers.

She also flashed her bottom on one occasion when being dragged into court.

At the conclusion of the trial, Judge Stuart Durward charged Ogawa with contempt for her "disgusting behaviour" during the proceedings and sentenced her to four months' jail for that offence.

In April, Ogawa indicated she would appeal against her convictions and sentences for the four Commonwealth offences and the charge of contempt.

On Tuesday, she filed an application in the Brisbane Supreme Court registry indicating she would be seeking bail pending this appeal.

The bail application will be heard later this month.


Tickets to see her next appearance go on sale Monday.

Megumi Ogawa is an Associate Lecturer in the School of Law and Justice at Southern Cross University. She holds the degrees of BA (Law) and MA (International and Business Law) from universities in her native Japan and a PhD (Law) from the University of Queensland.

Hmm, for someone with a BA, MA, and PhD you'd think she would have the sense not to go nuts in court.
She will teach International Business Law, Intellectual Property Law and the Information Technology and the Law in 2009.

After a six month hiatus in the big house perhaps.

And the plot thickens, seems it's not her first brush with the law, or imprisonment.

Wow, I'd call that a fair and balanced representation of her plight. Everything I've read before has had a rather critical slant. This one presents the issue in a different light and I hold a bit of sympathy for her whereas before I wasn't sure what to think.
I will not abide ignorant intolerance just for the sake of getting along.

I suspect it boils down to something like this...

Japanese doctoral students are, in affect, awarded PhDs from their supervisors, who, decide when they will allow their students to submit their theses (internally). There is an underlying idea in Japanese universities that it is the sensei's responsibility to make sure that students pass, and in instances where this does not happen, the finger first pointed is in the dirrection of the sensei.

On the other hand, Australian students are expected to crank out their theses largely by themselves, with minimal input from supervisors, and to get their theses to a standard good enough for external examination. If they aint up to par, they dont pass.

The long and the short of it, this chick couldn't cut it.

While you're right about the respective academic assessments, you're misunderstanding...she eventually got her PhD, so I think there's something else involved in the case.
I get the feeling that she simply forgot to renew/change her visa, got nabbed for overstaying and her real problems started from there.
I think the Aussies are bleeding hearts. They should do to her what Dr. Ogawa's own Japanese do with visa overstayers -- demonize, detain and deport. As someone with a PhD in law (albeit in a field totally unrelated to visa issues), she should have known better about her residency qualifications.
The only sympathy I have for her is that she's stark, raving mad and needs pyschological help. She should be allowed to stay in Australia to get that because there's not a hope in hell she'll get the treatment she needs in this country.

In any case, she's an idiot to be representing herself.

It should also be pointed out that in Japan, the majority of professors teaching law have not actually practiced law - that is to say, they hold graduate degrees in law, but have not passed the national bar exam, and have never actually worked as lawyers, let alone stood in a courtroom running a defence.

A JAPANESE law lecturer jailed for contempt, which included flashing her buttocks in court during her trial for making threats to Federal Court officials, has been refused leave to appeal to the High Court.

The Queensland Court of Appeal had previously dismissed her appeal against conviction.

In one of the Queensland courts longest running sagas, Megumi Ogawa's case went to the District Court last year after many preliminary court appearances in which her fitness to stand trial was questioned.

A District Court jury in Brisbane found Ogawa guilty of two counts of using a carriageway to harass and two counts of threatening to kill on various dates between April 12 and May 19, 2006. Judge Stuart Durward then charged Ogawa with the contempt for her "disgraceful'' behaviour moments after the jury delivered its verdict.


He said it was unlikely any court in Queensland had ever been witness to such appalling behaviour.

Ogawa's behaviour included screaming loudly, claiming she was about to soil herself, trying to disrobe and exposing her buttocks to a journalist while being dragged into court in handcuffs.

I bolded that last part for emphasis. She's a real prize, no doubt.

i dont think she is a nub job... if that was the case, we would have to let half the convics off the hook and call it a day. dont give them too much slack!

I'd say just the typical Asian etc misfit in Oz trying to take advantage of the system and the way successive govts forgot that their role is to govern for Aussies and not the flotsam of the fucking world who think we owe them something.

It's not so bad if Asian countries give the same fucking good deal but they don't with their xenophobic sytems and ideas that they're allowed to force foreigners to carry ID all the time, act like foreigners are tourists when they've been working and living in the country etc etc.:confused:

I don't want Oz to be like Asian countries but I'd like us to crack down on the advantage takers who think we're suckers.

And then there's the 'asylum seekers' Chinese who overstayed their student visas cause of course there aint never was an intention of going home - saw on the net last night they were up on a fucking detention centre roof threatening to jump 'if their demand are not met'.

Yeah, sure, my folks and friends in Oz want you there as residents and then citizens, I mean you're such fucking reasonable people and you'll be such a fucking asset with your assumptions of superiority. You can hold a country whose laws you broke to ransom, right, because you're Chinese. Back in China any foreigner who does any shit they don't like ends up disappeared or with a bullet in the head.
