The fact that this occurred in the US makes it interesting. If the same thing occurred in Japan (of course it does ... frequently) and a case was brought to court, how would the Japanese court decide?

A few discrimination suits have been tried in Japanese courts with the ruling in favor of the plaintiff (Debito's sento suit, and the case of the foreign woman who was told she wasn't welcome in a jewelry shop in Hamamatsu come to mind), but the grounds in this case seem to be a little less clear.

It's also interesting because the offenders were minorities. I don't think I see discrimination suits against minorities too ofter in US news.

Don't you know Asians don't count as minorities in the USA, especially Japanese?
They tend to be successful, work hard, and not ask for government handouts.

As far as I can tell reading the full article, the plantiff won a settlement for the department promotion board basically punishing her for filing a complaint against them for some unfair labor practices. The court found that she was unfairly punished by the board - the board gave her a shorter and non-tenure-track contract - for filing her complaint. One of those named in the suit was a Japanese national, but the others were not. So, she didn't sue a member of a visible minority, rather one of those in the group named in the suit was a visible minority.

That kind of puts them in a similar category as Jews albeit on a lower rung:

- Both are considered racial or ethnic 'minorities' but neither qualify for affirmative action or quotas (unless they are applied against them as in academia ... eg. too many Asians).

- Both have groups in society which hate their guts ..sometimes coupled with a few conspiracy theories accusing them of somehow controlling the world, the economy, the media, etc... and at the same time, examples of super-rich super-influential members of society that help sustain those theories.

Considering the fundamental lack of awareness about human rights and the rights of the individual -- that's for the locals, let alone those of us outlanders -- I'd say the chances of winning a case like this are about the same as Japan producing the world's next John Holmes.

I can imagine that the university is less than happy that it had to deal with a discrimination lawsuit, especailly one as messed up as this one. I wouldn't be surprised if the university fired those professors if they haven't already.
I am not really sure where I am going, I just hope that when I get there, I can sit down because I am sure my feet will be tired.

All psychos aside, if you cost your university $164,000 in a discrimination suit, not to mention the damage to the reputation of the school, you don't have a leg to stand on and its time to go.
I am not really sure where I am going, I just hope that when I get there, I can sit down because I am sure my feet will be tired.

That's what it would see like to me as well, but there sure are a lot of people that have done this and worse and are still gainfully employed at the chagrin of their Universities.....

Look how long it took to get rid of Ward Churchill and all the problems he caused, not only his school in Colorado, but others. There are a lot like that yet, nothing every seems to happen to them. It seems like it's always the little guy that gets stomped on by the school when he raises a question about his rights, or tenure, while the most vocal and extreme of the rabble rousers never get touched.....

I received a BA in Japanese from the UO in '06 and am currently an grad. student in Linguistics Dept. so I am familiar with the parties involved. There are some serious problems here with Mrs. Rogers claim.

First she is trying to portray herself as someone who was passed over by a less qualified colleague but who could that be? Reiko Hashimoto; a PhD who is probably the best language teacher I have ever seen? Kaori Idemaru; a PhD specialist in Japanese linguistics? Rika Ikei; a graduate of Kyoto U. who has taught at MIT and Cornell? Who was this horribly unqualified Japanese she was passed up for? We want to know.
Could it be that Mrs. Rogers was passed over because she wanted to focus her research attention on the indigenous languages of Taiwan while her colleagues wanted to focus on the language of the department? Yes, that is right. Mrs. Rogers wanted to get paid as teacher/researcher of Japanese language while focusing her research on a completely unrelated subject.

It should also be noted that the UO's Ling. Dept. is of the functional branch while Mrs. Rogers was trained in the formalist approach. This could have also been a factor in this situation.

I think another major whole in her claims is the fact that at that time Nancy Iwakawa (a white American) was a senior instructor in that department. So if Fujii-sensei was such a bigot how was Iwakawa-sensei able to obtain such an achievement?

Could it be that Mrs. Rogers is a whiny little trouble maker that consistently encouraged colleagues and students to file grievances with the university? This is actually the main reason she was pushed out. Not her race but her playing of the race card

I think its funny no one has brought up the issue that Mrs.Rogers may have simply been not a good teacher. All the academic credentials in the world do not make one a good instructor.

Good post and background YariChin-Chin. Those of us that have been here for a day or two, have seen a lot of these allegations come and go. That is not to say that Japan doesn't have a Lion's share of discrimination incidents, but it is far to easy to make an unsubstantiated (or phony) allegation and claim that it's all "because I'm a gaijin." There are a lot of these. This is too bad, because it is such a shaky area and easy to gain a lot of media attention. When you think about all of the legitimate cases, it only takes one such trumped up, phony allegation by some dipshit to further reinforce the public's opinion, indifference, or out and out prejudices against fgs, which do nothing but set back any legitimate gains we have been lucky enough to gain in this area.

They need to kick her ass out of country, or better yet, send her to Toranomon as penance to do a 3P in the goat pen with Iraira and me officiating.....
