It's a grey area but most likely not. Non sexual nudilty is generally not illegal and when people are arrested they generally win in court. I don't think nude photos are bad in and of themselves. However, the way the guy talks about how he likes the picture of her at 13 the best because her ass is filling out and her tits have started to develop is pretty sick.
