L.A. Sushi Restaurant Sued Over All-You-Can Eat Deal

L.A. Times: Diabetic's discrimination lawsuit against restaurant is hard to swallow
David Martin was in the mood for raw fish, and he liked the deal offered by a Studio City sushi restaurant: all you can eat for $28. He took a seat at the counter and started ordering. But it turned out that Martin didn't really want sushi, which includes rice; he wanted all-you-can-eat sashimi, which is just fish. He began picking the seafood off the top and leaving the rice. Restaurant owner Jay Oh told Martin that if he wanted the all-you-can-eat price, he'd have to eat the rice too and not just fill up on fish. Martin replied that he has diabetes and that he can't eat rice. Oh said he offered to prepare sashimi for Martin. Two orders of sashimi cost $25, or $3 less than the all-you-can-eat sushi deal. But Oh said Martin declined the offer. Martin left the restaurant after being charged a la carte prices for the sushi he'd already ordered plus $1 for a cup of green tea. Two weeks later, Martin filed suit in Los Angeles County Superior Court. It seeks at least $4,000 in damages for the "humiliation, embarrassment and mental anguish" Martin says he suffered after being discriminated against "on the basis of his disability"...more...

In this case, "all you can eat sushi" means "all you can eat sushi." Hence, if you can't eat it, you can't order it.

Kanchou basically hit this one, sashimi and sushi are different things, and sorry to the woeful diabetic or anyone who does not know this. He should consider it a cultural/language lesson, and hopefully the restaurant's lawyer will simply define for the ignorant masses that sushi is "sashimi with rice" and is not "sashimi", and everyone can go home.
When I used to go to all you can eat sushi places in LA, it was clearly stated that you must eat the rice also or your wallet would get raped.

I think they should've just let him eat just the fish - and be done with it.

But as soon as he says $4000 for mental anguish, I've lost all respect and sympathy for the guy.
I broke a mirror this morning, which means I should be getting 7 years of bad luck - but my lawyer says he can get me 5.

Whether or not this case makes it to trial may depend on whether or not that is explicitly stated on the menu. Though the article implies it might be it's not so clear. Either way, Martin is an asshole.

Imagine if I went to an all-you-can eat pizza place and just picked the topings off and threw out the rest. I wonder him many pizzas it would take to fill me up.

If the rice tasted like camel shit, but the fish was good, I could see the customer having a case for leaving the rice on the plate. Maybe it's a case of "I want it done my way, or I'll sue and/or take my business elsewhere." I wouldn't be surprised if the Martin a^hole is from OC.

That's the best part of the article, so many "all you can eat sushi" places in so cal run by Chinese/Koreans. Ignorance being what it is, most customers think they're Japanese when they are greeted with "Irashhhsmasss" upon entering. They usually end up on the news for poisoning customers. (not properly storing the fish) I don't think I've ever seen a Japanese run all you can eat sushiya.

Did Todai a few times (college kids don't know any better). My neighbor had a stomach pump machine. There was some place in Westwood that we would go to, and another place in the Valley that would get closed for vermin infestation within a week after we would eat there.

I love the other top minds who replied. Really though, I am one of those who really dislikes reader/viewer comments. They can get way off topic way too quickly and usually never add anything to the story other than the kinds of things that make you hate comments.

I really do not care for opinionated news. I feel the reporter or presenter should simply present the news and not throw in their "well thought out and informed" opinions.
