Student faces 10 years in Japanese jail for pot cookies

A Colorado School of Mines chemical engineering student remains in a Japanese jail after a friend of his says he mailed the student three cookies and four pieces of candy infused with marijuana.

Japanese prosecutors appear to be using the country's very strict anti-drug laws to go after 25-year-old Tim Wilson. Wilson was attending Tohuku University in Sendai, Japan, as an exchange student when he was arrested back in August.

He's remained in custody ever since.

"They keep pushing the trial back," his father Jeff Wilson said on Wednesday. "Originally, they told us it would be no later than Oct. 24. Then they told us December, and then two weeks ago we found out it would be in January."

Tim Wilson's friend agreed to speak with 9NEWS on Wednesday if we agreed not to use his name. He said in May he mailed three peanut butter cookies and four "Cheeba Chews" to Tim Wilson inside a package containing other items such as books and CD's.

Learning a lesson the hard way. I am sure he is grateful to his pal back home for the care package. :noose:

Can they really prosecute the student for this? It seems to me without evidence of an attempt to procure such goods, their arrival in the mail would only warrant a simple confiscation, search of his premises and perhaps a warning. Otherwise it's become very easy to have people I dislike thrown in jail.

They can still charge him...but they now have to prove intent. Without evidence of him requesting or ordering the goods they are going to need a "confession".

stinky case as hell, even the basterd from the french police need the person to receive the parcel to make arrest. So when they know, they just go along with the mail man... upon delivery they arrest ANY people receiving the parcel (even your grandma) for possession of whatever was illegal init...

That was the law in Japan, unless it has been changed recently. Authorities must make a controlled delivery to show receipt and intent. There have been cases where the recipient has beat the charge with an affidavit from the sender saying that the recipient did not know, nor "order," what was in the package. Needless to say the sender did not come to Japan.

I also bet if Tim had've copped to it he might have been out of the clink and back in Colorado already. Heads they win, tails you lose. I also wonder if it wasn't hash oil in which case the prosecutor may be taking an even dimmer view. Anyway whatever happens from now he's one fucked gaijin. Yay drug war.

This being Japan, I am quite sure getting a confession out of this guy will be no problem. They can virtually detain him or keep him incarcerated for a long time. Time is on there hands and since Japan is not the US, they won't let him lawyer up, so go figure.
