What kind of employee if tax form has to be submitted

Postby wangta » Wed Nov 20, 2013 2:06 pm

in December rather than March?

I've heard that if your employer gets you to submit your tax return in December instead of the following March then you are on a particular classification as an employee no matter your visa status as this or that. If an eikaiwa employee has to submit their tax form in December what does that say legally about their status? Anyone know?

I'm not sure about the rules related to employee classification however I'm a permanent full-time employee of a Japanese IT company (non-technical role so my status is Humanities/International Relations Specialist for the record). I have to submit my tax forms each December and I get my tax return from my company at the end of each calendar year which means they're doing their adjustments in December. People I know working in other industries are doing the same whether they're permanent or contract employees so I'm assuming it's fairly standard practice and doubt there would be a special rule for eikaiwa companies.

If you're filing yourself, you need to do so by March. If you're working full time for a company but have side income they know about and want them to do your taxes for you, you'd need to submit everything in Dec (I think).

Yep, the Jerk has it right. Tax forms in December just mean that your employer is doing the end of year adjustments and you are getting your return earlier than everyone else too, as a result. If it is your sole source of income, this is best. It says nothing further about your status other than that you are an employee and that the employer is deducting tax from your income and preparing and submitting tax forms on your behalf.

More info just in case:

Sole proprietors (個人事業主) work for a company but are technically self employed so they have to take care of everything themselves including insurance and pension payments. That's different from incorporating and contracting yourself out or working as a temp (派遣社員) or sub contractor (業務委託) through another company.

Sorry, lame play on Meatloaf :biggrin2:

I smell an FG Grapevine urban myth. Depending on where and from whom you heard it, I would go with what everybody else is saying: the accounts people are getting it all in now to prepare for timely filing by the deadline at the end of the fiscal year. As somebody noted, that gets your return back quickly, too. Yea.

Also, do keep in mind your employer has a legal duty to clearly explain your exact employment status, though given the murkiness of labour law and any language difficulties, it might end up being clear as mud.

At any rate, I would not worry your Wangta little head about it. :-D
