Only one female involved, and there is nothing to say that the warehouse centre initiated any charges. Since the events took place over six months before the news report, my guess is that for some other reason, the police saw what was on one of the guy's phones, and then got the story and names of other perpetrators, and then, and this bit is important and instructive, THE ONLY CRIME THEY COULD COME UP WITH TO CHARGE THESE GUYS WITH was trespass, due to the location. The cops probably have no idea who the female is, anyway. I would imagine that either she was obscuring her face, or that the focus of the resulting videos was, err, elsewhere.

There is also nothing to suggest that this lady was pissing at the front door to the warehouse centre anyway.

I'm going to say that I have lost interest in doing research as to whether the owner of the land has to do anything before the charges of criminal trespass can be laid.

I think you and many others can imagine the situation where, in the course of the police asking these guys about their seven years of chasing photo opportunities of ladies taking a slash, that the guys said they had taken the photo/video at X location, and that they did not have permission to be there, and that that got incorporated into a confession, and maybe that is all that is needed for the charges to be laid.

The only reason I bring it up is it's often said the way Japanese cops/law operates, for something like that, someone needs to file a complain/press charges. Obviously those pervs getting shamed is for the better, just curious as to how easily the cops can make an arrest like that without the property owner pressing charges.

I have previously mentioned my distaste at the cops releasing to the media the aspects of these guy's behaviour which has nothing to do with the crimes they have been charged with.

Looking at this another way, you could almost say that this is an admission of defeat by the cops. If those guys hadn't filmed in the grounds of that warehouse, then the end result of the investigation of seven years of activity would have been to let the guys go. I'm not sure that is the message you would want them to receive.

I like Wagyl's hypothethizing. As I understand it, the Japanese system works like the Crown Prosecutor system we have: a crime is a crime regardless of a complaintant pressing or not; it's up to the authorities and does not require an active complaintant like in the US system (as seen on TV, mind). As Wagyl said, they gathered evidence of a crime and pressed ahead with their prosecution of it, and as usual the wussy ass pervs involved confessed.

What they did is assault, and in essence (or intent) a sexual assault (commensurate to panty thieves); they're lucky to get off so lightly. Just to ramp up what I saw as Russell and other's sense of offended decency I would have liked to see them attacked with Pointed Sticks. Woman have a hard enough time without having their pee filmed.

I think Choko is right in the sense that without somebody kicking their lazy asses the cops often don't proceed with charges so they never come to the attention of the Crown, but that is a practical level matter not a formal one.

I think what you've seen on TV is generally correct for certain types of crimes but as with so many things in the US it depends on the state. A friend of mine in Washington had to go to court on charges related to a fight he had. It was one-on-one between two grown men, no weapons were involved, no one was seriously hurt, and neither of them wanted to press charges but the state went after both of them. In the end they both got off with warnings and no conviction so it really was a waste of time for everyone but their lawyers. It happened in a small quiet town so my guess is the local prosecutor was just bored and had nothing better to do.

Good point about the state vs. federal or national thingy. Forgot about that. Weez all federal when it comes to criminal law. I also wondered after I wrote that bit if a lot of the US tendency to require an active complaint isn't actually a practical matter, given how busy courts and prosecutors are; it certainly cuts down on cases like your friend's. Maybe a slightly different cultural/philosophical issue, given Canada and Japan's relative concern for abstract order over actual repercussions or effects or whatever. And maybe Washngton state's as well?? And I do always take TV legal with a grain of salt.

Well, arrested for, charged with, and convicted are 3 seperate things...so yeah, you could be right. Maybe this is the "save face by making them lose face, if nothing can actually be done about what has been discovered."

Ehhhh, I get your point but in this particular situation it wasn't exactly a restricted public space...so how can trespassing be a crime on private property unless the property owner objects to it? (if the cops "encourage" the property owner to press charges, they'd probably cooperate.)
