I think you and many others can imagine the situation where, in the course of the police asking these guys about their seven years of chasing photo opportunities of ladies taking a slash, that the guys said they had taken the photo/video at X location, and that they did not have permission to be there, and that that got incorporated into a confession, and maybe that is all that is needed for the charges to be laid.

Looking at this another way, you could almost say that this is an admission of defeat by the cops. If those guys hadn't filmed in the grounds of that warehouse, then the end result of the investigation of seven years of activity would have been to let the guys go. I'm not sure that is the message you would want them to receive.
