A woman who was jailed for duping her friend into having sex by pretending to be a man is to appeal against her prison sentence.

Gayle Newland, 26, was jailed for eight years after she tricked her friend for two years by disguising her appearance and voice and persuading the woman to wear a blindfold whenever they met.

The pair had sex about 10 times until the complainant took off her mask and saw Newland wearing a prosthetic penis, the trial at Chester crown court heard.

I disagree. It's rape by false pretence. What she got was not what she consented to. Not as physically dangerous but not unlike an AIDS carrier not disclosing their condition to their bonk buddies. I found it refreshing that such a snicker worthy case was taken so seriously, especially since there are no men involved. At the very least the victim must be borderline mentally incompetent, and perhaps that was accounted for in the sentencing. At any rate, this should help rein in the scourge of coercive, deceptive lesbianism that is sweeping the western world and threatening the very bases of our democratic freedoms and education systems, not to mention the purity of essence of our precious bodily fluids.

Yes, well put. Along with the candy coded terrorist refugee infiltration scheme and the flouridation of bottled Italian fizzy water, Coercive Lesbianism is truly the Trojan Horse of our times. It actually only occurred to me as I wrote back to Russell that the victim might well be borderline, and as you noted, hence the severity of the sentence: we can't always prevent the weaker from being preyed upon but we can sure whack those that do when we catch them. Hopefully the perpetrator will develop an appreciation for receiving stiff punishments as well as doling them out
just coz this whole story is still way too snicker worthy

Here is an almost interesting radfemcomsymp overdeterminative deconstruction of the case, although I do note she avoids discussing the elements of deceit and manipulation, which the judge mentioned and the jury seemed to consider relevant. She also charges that the same judge has given less stiff sentences to paedophiles, and that would show undue bias in MYHOMO. I think she brings up a few good points but seems to be skirting the issue

Though Burke is correct that inconsistent contradictory sentencing is a problem of the criminal justice system that needs to be addressed that doesn't mean this women should get off lightly. After all two wongs don't make a right.

It's speculation on my part, but any potential judicial bias aside the victim's mental abilities and state must have played a factor in the stiffness snicker snicker of the sentence. She must be a complete moron or a mess to have been fooled like that, and therefore deserves greater protection under the law.
And if stuff comes out on appeal that makes me rethink it I'll change my mind.

Do you not consider what the convicted woman did to be a form of serious sexual assault?

The perpetrator coerced the victim to have sex with her under false pretenses. I am not saying that is acceptable, but it is not completely dissimilar to a guy talking a woman into having sex by pretending to be very rich. If the woman is gullible, would that justify an 8-year prison sentence?

Or suppose the guy had a small dick and used a dildo to satisfy the woman, pretending it to be his own. Would that get him behind bars?

Sorry to become a bit philosophical about this.

And, we're talking here about Europe. An 8-year prison sentence is what you would typically get for murder.

In England and Wales murder gets a mandatory life sentence together with a minimum term before eligible for parole. The minimum term is usually 15 years but can be much longer. Some get a whole life sentence.

Depending on the particulars of the case at hand, sure, it might. If it was simple deception, no; I would suggest civil litigation there, if at all. But if it was repeated and predatory, as this case is purported to be, sure, why not? And if the victim is of some sort of diminished capacity, definitely. Sex by false pretence is an assault, and the more vulnerable the victim the harsher the sentence should be. I am not talking about Matsuki/PUA style pickup lines being used as panty remover, but mostly because that is a whole different quagmire that is likely unenforceable: it would effectively be the micro-management of social relations.

Au contraire. Yours is a good answer, but we seem to disagree about punishment. I should have said a very few, rather than some, murderers get a whole life term. Less than 8 years for murder isn't nearly stiff enough to my mind - at least not in England. Murder is very dear to the English heart - those Agatha Christie and other books are no co-incidence. There needs to be a very solid deterrence for that lot. Especially the middle and upper classes.

Canada sounds similar: only the most heinous and incorrigible get a true life sentence, and that usually involves recidivism and subsequent designation under the Dangerous Offenders Act, which detains them at Her Majesty's pleasure. It also means that a murderer caught and imprisoned was released and killed again, which brings us back to the fundamental irrelevance of any individual life when measured against normal people's safety and security.

Plus it's always fun to suggest that individuals are mere cogs in a greater machine and the ones that don't fit deserve to be dismantled and discarded. It drives my lefty friends batshiite, but Spock would agree
