Japan Scandal Inc.

Postby Russell » Thu Oct 19, 2017 10:42 pm

Olympus, Takata, Toshiba, and now Kobelco, it's hard to keep track of them, so time for a dedicated thread.

EU air safety body: Be wary of Kobe Steel

The European Aviation Safety Agency has recommended that companies suspend use of Kobe Steel products when possible.

The recommendation on the agency’s website follows the company’s admission that it has faked inspections data on products sold to hundreds of companies.

The agency said companies should thoroughly review their supply chains to identify “suspected unapproved parts” from Kobe Steel that they may have used.

“Where alternative suppliers are available, it is recommended to suspend use of Kobe Steel products until the legitimacy of the affected parts can be determined,” the agency’s notice said.

It says the directive did not indicate an “unsafe condition” requiring further immediate action such as an airworthiness warning. But the agency said it had contacted Japanese authorities for more information.

Kobe Steel had no immediate comment on the announcement.

The metals and equipment maker said late Tuesday that it would “sincerely cooperate” with an investigation by the U.S. Department of Justice.

The company has reported it discovered bogus inspections or faked data for steel powder, aluminum flat-rolled products and castings, copper strips and tubes and forgings, among many other products.

It has acknowledged the fudging of inspections data might have begun up to a decade ago and affected more than 500 customers.

More

"Might have begun up to a decade ago" my ass.

I recall buying an HSS 10 mm steel drill of Kobelco almost two decades ago, and it became dull after drilling merely three holes in 2.3 mm steel. That was too much even for me, so I went back to the home center to complain, and they immediately replaced it, no questions asked, leading me to suspect it was a common occurrence.

Though the replacement was fine, I've since avoided this brand like the pest.

To be fair, with Olympus it was dodgy accounting, their products were not an issue. It was terrible that people who make excellent lenses for medical use had their livelihood threatened by dickheads.

And so it was basically an accounting problem with Toshiba. Nevertheless, the shareholders were ripped off a lot of cash due to their false accounting.

Add Hitachi to the fuck-up list.

Fault delays new high-speed train's first journey from Bristol to London
BBC News | 16 October 2017
Broken air conditioning and a 41-minute delay have overshadowed the launch of the UK's new fleet of high-speed trains.
The Hitachi 800 engine will be faster and carry more passengers and will run on GWR for the next 27 years.
But passengers on the first Bristol to London service arrived late and some had to dodge drips as water leaked from an air conditioning unit.

Not a serious issue. Could be any one of a number of causes. I'd be more worried about Kobe Steel aluminium being used in the construction.

The thing that unites all these horror stories is salaryman culture. It's poison.
It is a tale told by an idiot, full of sound and fury, signifying nothing.

Sure, it must have been management's fault, like this French management error.
Nissan to suspend all Japanese car production
PTI | TOKYO, OCT 19:
Nissan today said it was suspending all production destined for the local market, as Japan’s number-two automaker grapples with a mounting inspection scandal that has already seen it recall some 1.2 million vehicles. "Nissan decided today to suspend vehicle production for the Japan market at all Nissan and Nissan Shatai plants in Japan,” it said in a statement, referring to an affiliate.
The announcement comes weeks after the company announced the major recall as it admitted that staff without proper authorisation had conducted final inspections on some vehicles intended for the domestic market before they were shipped to dealers.

I'm not a huge fan of the widows and orphans justification but it is awful to think of Mrs Tanaka who tucked some of her husband's taishoku-kin in a reputable company with more skeletons than St Mary-at-Lambeth.

In other news, the shareholders in the UK's recently nationalised Post Office are making out like bandits.

Hmm, looks like Ghosn's detention is not going according to plan.

Carlos Ghosn’s arrest is more about Japanese criminal justice than corporate governance

Is it just me who thinks his deferred pay is nothing more than taishokukin?

No, the real significance of his arrest will likely prove to be in subjecting Japan’s criminal justice system to intense global scrutiny. You can’t use a reporting violation as a pretext for detaining a famous Brazilian-Lebanese-French business leader associated with multiple global automotive brands in an unheated cell for weeks with limited access to lawyers and almost no contact with family members before formally charging him with a crime without generating some negative press. In a Nov. 22 article on news analysis site Agora, former economy ministry bureaucrat and university professor Kazuo Yawata wondered whether Ghosn’s arrest and removal might be a sign of the “suicide of Japan’s judicial system.”

One can hope...justice =/= holding uncharged individuals for 21 days on with baseless excuses, secret proceedings, no cameras/attorney allowed interrogations, and withholding (manufacturing) evidence.

Think about it: How long could you simply vanish, separated from family, pay bills, respond to e-mails or do your job, before it caused serious long-term damage to your life and career? In addition to encouraging confession, even a false one proffered just to escape the stress of constant interrogation and life in an uncomfortable cell in a facility controlled by your interrogators, the pre-charge detention system gives police and prosecutors in Japan incredible powers to punish someone severely without even putting them on trial.

Basically THIS

No clue about Ghosn's "guilt" here but if he is innocent or found to not be liable for whatever Nissan is doing, it would be a nice bitchslap to the "justice" system here.

They kept him for a second period. So it sounds like he's not cracking. Any chance it goes to trial without a confession?

I don't think Ghosn would be, where he was, if he'd crack so easily. A little embarrassing for the Japanese justice system, as in the case of a rich and famous guy, the whole world is looking on. He is not your typical overstaying gaijin.

OTOH for Ghosn to live a few weeks in an unheated cell with a bit of caning and some sleep deprivation won't hurt. It is likely quite similar to how a lot of his underlings live most of their lives in order to make his luxurious life style possible

(My guess is that continued "questioning" for a third period would make Japan look too medieval in the world press---Even Al Jazeera is critical of Japan's (il)legal system.)
Ghosn could win bail as court quashes bid to extend detention
Dec. 20 | Tokyo (AFP) - Carlos Ghosn could soon be freed on bail after a Japanese court Thursday threw out a bid by prosecutors to extend his detention, in a move nearly as unexpected as the auto tycoon's sudden arrest.
The 64-year-old Franco-Brazilian-Lebanese executive has languished in a Japanese detention centre since his November 19 arrest for alleged financial misconduct sent shockwaves through the business world.
But in another stunning twist in the case, the Tokyo District Court said prosecutors had filed a bid to extend his detention on December 20, but it was "rejected".
In the Japanese system, it is extremely rare for the court to turn down prosecutors' request to continue the detention of someone who denies the allegations as Ghosn does, and the decision wrong-footed everyone.

Hold the press conference - Ghosn has been re-arrested, reports say, this time on aggravated breach of trust. This is a very serious crime and the one prosecutors are believed to ultimately want to convict Ghosn with.

Prosecutors serve fresh arrest warrant for Ghosn over breach of trust
KYODO NEWS - 23 minutes ago - 10:55
Tokyo prosecutors on Friday served a fresh arrest warrant for Carlos Ghosn, the ousted Nissan Motor Co. chairman, for aggravated breach of trust against the Japanese automaker.
The move came after a Japanese court rejected Thursday a request from prosecutors to extend the detention of Ghosn, who was arrested twice for allegedly understating billions of yen of remuneration in securities reports presented to Japanese regulators from fiscal 2010.

Apparently the statue of limitations is seven years, making 2015 the limit for charging him with that crime, but the prosecutors position is the time he spent out of Japan doesn't count.

Well, at least Ghosn Lite® is out on bail and the jailers can focus their full attention on torturing Carlos.

Tokyo court OKs bail request for Carlos Ghosn aide Greg Kelly
The Japan Times | Dec. 15, 2018
...
Kelly was granted bail Tuesday, making way for his release after spending more than a month in detention.
The Tokyo District Court set Kelly’s bail at ¥70 million, according to the Tokyo Prosecutor’s Office. Prosecutors can appeal the decision.
Kelly, a former representative director of the Yokohama-based carmaker, was indicted this month along with Ghosn for allegedly understating Ghosn’s remuneration in securities reports over a five-year period through fiscal 2014. They have denied the allegation.
