To my fellow FGs: Divorce help

How do you get divorced if your wife is in Japan and you are in the United States?

I havent been around here recently because I'm in college right now. I have to use the ghosty FG interface because of the big bold F*CKEDGAIJIN on the front page.

When I get my job working in the computer lab, I'll post more regularly. I dont even have internet at my house any more right now, but that will change.

Anyway. I've made a final decision and the wife will become my ex-wife. She wanted a divorce before but she wanted a "paper divorce" for the money that the Japanese government would give her. I think she wants a real divorce, but wants me to be a sucker because she never intends to come to the U.S. She said she wants to, but she isn't making any moves to do that.

Anyway, do you guys know any nice Christian Japanese girls? :D

I can ask my gf in Japan or rather my good Japanese friend regarding your situation. Obviously the Japanese system is different than the American system so please watch your steps. Don't want you to get screwed by a wrong move......... But in the meantime, hopefully someone could get back to you sooner on your concerns so you may be at ease.

Where did you marry? If you married in Japan, your wife can hand in divorce papers to the city hall (after you have signed or hanko -ed them) for a mere 600yen. That's how I divorced my Japanese husband, he was in the UK and I took the papers in and got an instant divorce! (Best 600 yen I EVER spent!!!)

There was a divorce related thread on the LifeInJapan yahoogroups mailing list run by Arudo Debito a few months back.. might be helpful to you, though it was more to do with child custody than childless couples.

You might have a case for "abandonment": Under screwy Japanese law wives must follow to a new domicile when requested by a husband. Within Japan, a husband can file for an automatic divorce if his wife fails to join him after 3 months IF he requests it. (Obviously, the court is gonna hate the extension of this law for an overseas husband.) However, Father Joseph's always sage advice as seen below brings up the issue of your "support" now.

The big problem, as you are finding out now, is when one party doesn't agree. In that case you do go to family court. Failing that, they seek to come to some agreement that is enforced by the court.
You need to have a good lawyer with you when you go to the family court meetings and you should keep supporting her until you actually get divorced as they take that into consideration.

Got married in Japan.

Suppport her as much as I could until I realized she wasn't making any movements to come to the U.S.

I fell ill and was unable to even support myself.

After 4 years, she still isn't trying to come here.

So I'm through with the whole situation.

If your wife is agreeable to Kyougi Rikon then the absolute fastest way is to get on a plane, meet her at the Shiyakusho where her family register is kept. Show your passport, fill in two forms, pay a small fee, wait 10-15 minutes and the marriage is over.

If not, she can do it without you being there but you will have to get the forms sent to you, fill them in and get them notarized, sent back together with two valid forms of ID. Still fast and easy.

If she is not agreeable then you will have to come to Japan and start divorce proceedings here. You can't do this from outside Japan. It can be slow, te-dious and expensive. If children are involved you will not get custody.

More informtion still needed.

2. I'm a Christian. And I've found that being in a relationship with a non-believer is extremely difficult.

If you're saving yourself for another Christian Japanese girl FROM Japan in OHIO, you are in for a long wait.

Why not a nice exotic latina? Lotsa Christians there--and they're TOTALLY hot.

Easier in Japan

Steve is absolutely right.

I've been divorced in both Japan and Australia (which has pretty much the same divorce law as as the U.S., I guess).
In Japan, it's over in minutes (provided, of course, you agree). But, even if you agree in the West, it's still a pain in the arse. Back home, it took me 18 months, cost an arm and a leg, left me with bills for years -- and it was a mutual, no-fault divorce! That was 17 years ago. Now, I bet it's even worse.
If you absolutely, positively have to go through the courts, do it in Japan. It takes a hell of a lot longer, but Family Courts in the West is lethal for guys and you'll get a much fairer result here than you will in the U.S.

Oh hell yeah it's worse! Superannuation now comes into play, so your compulsory retirement savings are taken into account and raided by the courts. 8O

With the average new-marriage lasting 7 years, no informed and intelligent man in Australia should contemplate marriage today. Why should a man be pauperised for the simple fact of people growing apart? :(

I bet it's similar elsewhere in the US, UK etc. It makes me think of the divorce 'rights' lobby as being like a greedy trade union---creating so many disincentives and regulations to marriage, they eventually 'kill the industry'. Killing the goose that laid the golden egg etc.

But hang on. I thought you said men were being marginalised. Forced out of the work place by superior woman-folk. Surely this means men are now better off as the women are more likely to earn more than them. They can raid the wife's super fund. :wink:
