007 agent needed ASAP

I got married to a japanese woman(my ex) here in LA a couple years ago basically to help her out with her green card status. Now I want a divorce and ,surprise surprise, she doesn't because she doesn't have her permanent status yet. I need someone in the tokyo area to serve her on my behalf so that I can file the paperwork. I will provide a pic of her and partial address which should be enough to lead you right to her. She lives in shimo meguro.

Ok, ok, 'serve divorce papers' ...is "sewer service" (service without a signature/hanko) even legal in Japan or this situation? Gift-box the divorce papers and send 'em takyubin ...that ought to get* a signature/hanko.

This is one of the most unusual requests I have ever heard asked on this board..

Man alive I wish you success. Why not fly out and serve her ass yourself? take in the sites and sounds of the Big Concrete (NY= Big Apple) and do it up properly???

Might be fun. Maybe bring a camera and snap a photo or two of serving her??? Or ask Pongi to go along with you to serve her. That would make one of the craziest shows that he could produce LOL

I would be happy to but according to my lawyer she has to be "served" by a third party.

Have you tried the obvious, sending the papers via "Certified Mail return receipt requested"? Japanese people will always sign for mailman.

POINTS to CONSIDER:
--> Non-law-office process serving in Japan does not seem to be legal.
--> Process serving without a signature (aka "sewer service" or 'drive-by service") requires the testimony or affidavit of the person serving the papers if the service is contested by Mrs. Soulkraka.
--> Who the hell woulld wanna step in this hot steaming pile besides Super Pongi with video 'proof of service'? :P

I would be happy to do that but knowing what I know about her she wouldnt SIGN THEM, which according to my lawyer is a key issue here. This is why I have to have someone serve her who will fill out a form saying that they did in fact serve the right person.

Is "form" of the person serving the papers an affidavit that has to be notarized and witnessed?(real pain in the ass in Tokyo)

I got confused, first I read Tokyo your post, then I read NY in another post. Guess she's in Tokyo though. If she was NY, I do it for ya. I'd give it the whole grave/stern professional treatment too. Eh, hopefully someone in the Tokyo area can hook you up.

i never said she was in NY. We got married in LA but now shes(hiding out) in tokyo.

taro, many thanks again for the info. good lookin out . Ill have to crack the whip on this bar exam passing leech thats stuck on me and have him look into all this. :twisted:

Since Japan signed the Hague Convetion, go here for the U.S. Federal government's interpretation of the law.

Then go here for the authorized U.S. foreign process server. Last time I used them, the cost was about US$80 I think.

Why not just have it annulled. Have a judge anul it on the grounds that she ran out on the marriage and ran back to Japan.

I think its called anulment on grounds of abandonment.
